I purchased a Fire Luigi on ebay from Toynk Toys. They mailed me the regular Luigi. Right after opening the package I emailed them on ebay.com to tell them they sent me the wrong item. http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&rt=nc&nma=true&item=350405251293&si=bLSKJ9iyR%252B5v%252BS5UsL%252BHGN7dNdM%253D&viewitem=&sspagename=STRK%3AMEWNX%3AIT I got a message back saying that the ebay seller forwarded the complaint to the [email protected] that they don't handle it. I waited a day to get a reply from the [email protected]. I did not get a reply. I sent a email myself to [email protected] saying the same thing. They sent the wrong item and I would like a replacement. I wanted more days without a reply from them. I then filed a paypal claim for a item not described. The same day I filed the paypal claim I get an email saying here is a tracking number we are sending you a replacement. Then in this order I got emails. Order of events: Nov 08 - Sent them message on ebay.com for wrong item. Nov 09, 2010 - Sent [email protected] email. "I ordered the Firepower Luigi and I was sent Regular Luigi. Please, correct the mistake." November 12, 2010 7:17:27 AM - Filed the paypal claim. Your Not as Described dispute for the payment you sent to Toynk Toys on Nov 5, 2010 (Transaction 09D92567A0339361V) is now open. Fri, November 12, 2010 4:59:40 PM - Well, we attempted to fix the error but apparently you filed a claim therefore I guess we will stop the shipment that we sent today. Fri, November 12, 2010 5:30:48 PM - This is to notify you that Order

11/12/2010 17:08 CST - PayPal: Seller escalated this dispute to a Claim. And then they escalated the claim to paypal. *Note they have a 7 day refund/replacement policy so them not answering the email in a timely manner means they can enforce the bad return policy. They lied to paypal. If you view the ebay listing the description says "Super Mario Brother PVC 5" Figure Luigi Firepower".. BAN-SM0097-C I just wanted a replacement sent and them to pay for the return shipping because it was their mistake not my mistake. I have over 100+ transactions on ebay and over 1000+ transactions with paypal and others. |

This is one of the worst sellers on Amazon, hands down.
I ordered my item and they did not even ship it until after the last day for expected delivery.
To make matters worse then the order was wrong, which I can see from their feedback is not an uncommon issue. This seller makes Amazon look bad, when I tried to contact seller I never received any response until a few days after I filled a claim with Amazon, and then that service was very rude. Buy at your own risk and hope they don't mess it up because if they do you have little to no chance of having the situation taken care of in a prompt or courteous manner. |
