To Whom It May Concern: October 28, 2011 Faye Schreffler, Sean Autry of Thunder Valley Ranch and myself entered a contract agreement on June 2, 2011 consisting of 5 months of full care boarding for my 9 year old quarter horse gelding “Buddy†and my 6 year old American cream draft mare “Tina†in exchange for Tina’s son “My Mighty Thor†for the amount of $1500.00. 150.00 per month per horse. 150x2 = 300 a month x 5 months = 1500.00 (the purchase price for My Mighty Thor). Faye drew up the contract herself and stated boarding includes Spring shots which I was present when administered, pasture boarding, grain feeding, hay daily in winter or when needed and fresh grass daily in summer, fresh water daily, stalling if needed (severe weather or injury related), hoofs trimmed every 90 days (w/owners permission), wormer every 3 months (w/owners permission). Fall shots are the responsibility of the owner if stables takes care of it, the owner will be charged a shots fee. The contract also states in clause #1 that after this contract agreement has been met a clean bill of sale for My Mighty Thor will be signed over to the stables owners, and that at this time a new boarding contract will be drawn up at that time and agreed and signed by both parties. However, Faye sent me an email on Facebook July 23rd stating that she would not continue boarding after the contract agreement due to the drought and lack of hay. I understood and agreed to remove my horses from her property at the conclusion of this contract via facebook email response. She has changed her reasoning for not continuing boarding after the contract 4 times since the agreement to remove my horses at conclusion of contract.
Faye and Sean were notified in mid July that I would be moving out of state they were fine with that. I was out visiting my horses the day before I moved on July 29th, my horses were in good shape, I left a brand new bottle of Phiranna fly spray and took photos of both Buddy and Tina. At that time I asked Faye to trim Buddy’s hooves that they were in need of trimming, she agreed, but never notified me that it was taken care of. She never notified me of any hoof trimming or worming much less asked my permission to do so. Faye had asked me to keep her posted on how things were going with me once I got settled in. I kept in contact with her once I was settled in and had started working. I sent her numerous emails on Facebook doing so, also asking how my horses were doing, she never responded until I sent another email stating that I felt that I was being avoided. I did receive a response to that email with threats of a lawyer and having animal control pick up my horses as abandoned if they were still on her property November 1st. Not one time did she inform me of the well being of my horses. There were a couple of emails back and forth before she “cut this line of communication†and blocked me from communicating with her. She did this on September 21, 2011. I heard nothing from her until I received another Facebook email on October 17, 2011 in which I received and responded to on October 18th thanking her for unblocking me and my line of communication and informed her to release my horses and my belongings which were listed to Phillip between the dates of October 23-31st when the next available rig was available to him to remove my horses and belongings from her property. Phil contacted Faye on Monday October 24, 2011 to make arrangements to pick up my horses and belongings Wednesday October 26th at 10am. She told Phil that “she didn’t have time to mess with him and that he better not come out Wednesdayâ€. Phil made temporary holding arrangements for my horses and to satisfy Faye made arrangements to pick up Tuesday afternoon.
She has sent numerous threats to my facebook email, my aol email, and text messages. One of these emails included threats to my transporter with firearms, another about her dogs and that her boxer will bite amongst other threats including suing me for property damages caused by my horses, that my horses are wild, badly behaved, and dangerous. I have retained all of this and can provide it all if needed. I refused to respond to her threats and I forwarded all communication from her to my personal representative Robynn so her and Phil would be informed of what to expect from Faye and Sean. The Norman PD were called and the emails of the firearm and dog threats were shown to the officer who met them on October 25, 2011 at approximately 3:45 pm at Hwy 9 and SE 108th who called for another officer for backup before entering Faye and Sean’s property. When they arrived, Robynn reported back to me that both Faye and Sean were waiting with a young girl and four unleashed dogs including the boxer that bites. It was also reported to me that the officers required them to put the dogs away and Faye and Sean complied.
Upon arrival, my horses were located in a pasture with no hay and water that was described by Robynn as nothing more than “pond scum†and was bright green in color. My gray horse round bale feeder had been assembled and was in another pasture where my horses were not located with a new round bale of hay inside it. I was never asked or notified that my round bale feeder was being used, much less for their own horses, not mine. When I left it, it was in a shed on the west side of her car garage disassembled in 3 pieces with the nuts and bolts laying next to it. She referred to my equipment (round bale feeder, fence feeders, my Rubbermaid trash can for grain which was completely empty leaving me and Phil and Robynn to assume that my horses had not been fed grain in quite some time and two 40 gallon water tanks that I left for my horses to use) as “junkâ€. I provided necessary equipment to be used for my horses that were not used for my horses. My horses were not in the healthy condition that I left them in. They had lost considerable amount of weight, both very wormy, and dehydrated. They were sweaty and scared to death. Tina was covered in flies, Buddy had welps that Robynn believes could be from fly bites, and the Phiranna fly spray bottle I left was empty, apparently not used for my horses. It was reported back to me that Sean had admitted to running my horses, supposedly trying to catch them for an hour before Phil and Robynn had arrived. Both Buddy and Tina were scared to death of Sean and Faye and whenever either of them approached my horses both would start trembling. Robynn went into the pasture alone per her request and with proper horse handling within moments Tina came right to her and Buddy followed suit. She was able to halter both horses and lead them both simultaniously through the gate and close the gate behind them within 5 minutes of entering the pasture without any incident from either horse. Robynn also stated that as she was latching the gate closed Faye was approaching and both horses started showing signs of fear so she walked them around the shop away from Sean and Faye and to the far side of Phil’ s trailer to keep Faye and Sean out of their sight which seemed to calm both horses. They were both loaded onto the trailer within 20 minutes. As for any damages to their property, absolutely no damages were seen by Phil or Robynn or the officers that escorted them to the property, nor was there any mention to anyone at pick up about any damages to the property. Robynn reported that Buddy was showing signs of SEVERE stress and fear. Robynn reported that she asked Faye when she had wormed the horses and that Faye had changed her story 3 times, first it was a week ago, then two weeks ago, then sometime before her auto accident. Robynn said that was basically no useful information other that it would be safe to worm them both ASAP. Faye claimes that both of my horses were untrained, dangerous, and aggressive, that they have never been handled, yet Robynn and Phil saw a totally different picture, and both reported to me that my horses were highly stressed, scared and showing signs of neglect and or abuse. They were in no way aggressive towards Phil, Robynn, or Robynn’s husband in hand, and both were reportedly tensed up and started shivering any time that Faye or Sean approached, both horses were looking for security and comfort from Robynn and Robynn reports doing everything she could possibly do to keep my horses away from Sean and Faye. Robynn’s husband took photos of my horses prior to being loaded in the trailer and after loaded in the trailer together before departing Faye and Sean’s property. Faye has continued to harass me even after my horses and belongings were removed from her property which has caused me no other choice than to change my phone number. She continues to harass Phil demanding mine and Robynn’s contact information that she has no legal right to have. (She never had my address even on the contract)
As far as the contract, Faye nor Sean have completed the contract, they did not properly care for my horses, and violated the contract on many levels. As the legal owner of My Mighty Thor I am asking for his removal from their property for his best interest. He deserves a good loving home, and I have the perfect home in mind for him via Robynn. Also reported back to me, My Mighty Thor nor her other 2 horses were nowhere to be seen or heard on the property when Buddy and Tina were removed from Faye and Sean’s care. I will be consulting an attorney concerning the contract portion of this agreement and what my rights are considering the circumstances. I do not believe that I should have to sign Thor over to these people as contract states when they did not uphold their end of the contract and I believe no monies to be owed to them for board for the un-proper care of my horses or damages that were not presented or even brought up until after Faye was notified to release my horses and belongings to Phillip. If there were damages caused by my horses, I should have been notified immediately when any damage had occurred as any boarding facility would do, and if my horses needed vet care or were harmed in any way. I do not believe there are any damages.
I am prepared to provide photos, emails, text messages in correspondence with this whole ordeal.
