Tampa Bay Auto Exchange Inc. Misrepresentation of Vehicle Desription Holiday, Florida

I recently was the winningbidder on a 2008 Jaguar XJ8L onEBay sold by Tampa Bay Auto Exchange. The EBay listing contained a description of the vehicle, including but not limited to the options that the car was equipped with. In addition, prior to the winning bid date, I was also provided with additionalwritten advertisement materialsdeveloped by Tampa Bay Auto Exchange which further described the vehicle, including but not limited tothe options that the car was equipped with. Between the EBay listing description and the seller's written advertisement material, it was represented by Tampa Bay Auto Exchangethat the car was equipped with 3 options that were important to me and germaine to my decision to purchase the car: (1) satellite radio; (2) premium sound system; and (3) heated steering wheel.The car was delivered to me via auto transport on Mon. Jan. 3, 2011. Subsequent to delivery, I discovered that the car was not equipped with any of the 3 options listed above. I notified Tampa Bay Auto Exchange via email early morning Tues.Jan. 4, 2011that they had misrepresented thevehicle description andrequested that they reverse the sale transaction and make arrangements to take the carback and to reimburse me for my $525 auto transport cost.


To date, the seller has not agreed to reverse the transaction. Clearly, this is misrepresentation on the part of Tampa Bay Auto Exchange. Their company advertisement materialstouts "we don't play any games with you" and "our goal is to make each and every one of our customers 100% happy with their purchase". This is hardly the case. You don't earn 100% happiness through misrepresentative sales tactics. The proper thing to do in thiscase is for Tampa Bay Auto Exchange to acknowledge their mistake, reverse this transaction, correct their advertising materials, and sell it to a buyer that doesn't care about these particular 3 options.


I do have copies of all written advertisement materials furnished by Tampa Bay Auto Exchange.

First of all, the buyer, Anthony Frook, had his own father inspect the car 3 (THREE) times before he took delivery of the vehicle. 3 (THREE) times. His father came and inspected the car 3 times before Anthony Frook bought the car. Anthony Frook had the car inspected 'BEFORE' purchase. 3 Inspections by a FAMILY member. His father was a gentleman, very thorough and very intelligent. If Mr. Frook had 3 options that were important and germaine to his decision making and purchasing of the vehicle, why didn't he make those criteria important to his representative of his inspection of the vehicle. 3 separate inspections of the vehicle. And not once did Mr. Frook indicate that his purchase of the vehicle was contingent on the options being available on the vehicle. He was concerned about the mileage of the vehicle. Rightly so. And his father inspected the vehicle 3 (THREE) times. If the options that Mr. Frook were of such concern, why wasn't his representative, HIS OWN FATHER, aware of these requirements of the vehicle upon purchase??????? The vehicle WAS purchased through Ebay. Mr. Frook declined the buyer protection because he had his OWN FATHER do the inspection of the vehicle. Mr. Frook was not "SUCKED INTO" paying for the vehicle. He had the vehicle inspected threee (3) times before the purchase. He submitted his dispute to the BBB and they evaluated that the business did EVERYTHING REASONABLY POSSIBLE to resolve the dispute but the buyer was UNREASONABLE. Hmmmmm???? A third party says that the business tried to resolve the problem but the consumer did not find it acceptable. Mr. Frook had the car inspected. The purchase was NOT sight unseen. When you have a vehicle inspected 3 times over a two month period (TWO MONTH PERIOD), I doubt that there is "ANY SCAMMING" being done by the seller. The car was always available for an inspection. 3 THREE inspections were performed. By HIS OWN FATHER!!! Perhaps there was a 'FAILURE TO COMMUNICATE' what was important in the way of options. Hmmmmmm??? The car was NOT purchased sight unseen. When you have your own father inspect a car for you and the main concerns are 3 (THREE) options, wouldn't you check to see that those options were available on the vehicle???? Every one of our cars are available for inspection by an independent source. YOU chose the inspector. YOU decided to purchase the car AFTER inspection. And now you claim to have NO knowledge of any options on the vehicle. Why did you have 3 inspections of the vehicle PRIOR to purchase on Ebay??????? And none of the inspections alerted you to the fact that the 3 options you required were not on the vehicle?????? There are no false advertising claims. The BBB has even stated that. You had 3 prior inspections before the purchase of the vehicle. At any given time you could have chosen to not go ahead with the deal. But you didn't. The company even tried to work with you AFTER the purchase was finalized. And YOU REFUSED. You know you had the car inspected PRIOR to your purchase. Even the BBB knows this. And has said that the company has tried to resolve the problem with you. YOU REFUSED. We don't 'SUCK CUSTOMERS INTO PAYING VIA ANY MEANS'. Go ahead and 'WARN OTHERS'. We welcome inspections of our vehicles and still strive to make our customers happy. Our company did try to 'WORK WITH YOU' numerous times. But YOU REFUSED!!! You received the vehicle you had inspected 3 times PRIOR to purchase. We tried repeatedly to work with you and 'MAKE YOU HAPPY'.
