Nothing but Thieves On October 18, 2011, as I was leaving Chula Vista I paid a toll with my credit card. Days later my credit card account showed a $3.00 charge for South Bay Expressway and its merchant number; and I received a citation notice falsely accusing me of evading the toll. To SBX, I sent an affidavit, copies of my credit statement both from online and by mail. I also requested a copy of the credit receipt. Over the Thanksgiving holiday they sent a letter posted 11-23-2011 stating I had evaded the toll. They even declined as to send proof upon which they were relying upon to maintain their position that I had evaded the toll. I even gave them my e-mail. They said my explanation fell into a category for which they have chosen to reduce your penalty to a onetime courtesy of $10. I had two options: (1) Pay $13 ($3.00 toll +$10 fine) and say I evaded the toll or (2) Pay $63 for a hearing. Do you think I was actually given seven days to pay in accordance to the notice. Not!!! I received this notice on Friday November 25, 2011 and they want payment by Tuesday, November 29, 2011. So lets get this straight. You timely paid the toll. SB Expressway accuses you of not paying. You send legal proof that you paid--with their merchant number on it. They still accuse you of failing to pay the toll. If you contest, they want to pay you to pay the original fine for a hearing. If you don’t contest they want you to pay a smaller fine and lie to cover-up their faulty system. Either way they get a hold of your money drawing off of it what little interest they can in the interim. They evidently intend to cause as much financial and personal strife as possible to force people into giving them money they do not deserve. I intend to fight because this is wrong. I won’t lie to cover up an inept system they brag is so great. Once maybe excusable but two times. Get real. If there is an attorney for a class action put me down. The toll is a scam and I intended to notify consumer agencies, governmental offices about fraudulent business practice, and whomever else I can. Based upon my experience, I recommend avoiding the Chula Vista area until South Bay Express has their systems reviewed, revamped, and corrected. |
