SNO AUTO SALES, LLC Used Auto Sales Unfaitful Business cudahy, Wisconsin

On 08-13-11 I purchased a used 2007 Scion TC from SNO Auto Sales, LLC in Cudahy, WI . Prior to test drive I asked the salesman/owner (Khairi Alhassan) why the "check engine light" was on. He advised me that someone before us didn't buy it because the light had came on. I then test drove the vehicle. After the test drive, I asked if Mr. Alhassan could check and fix reasons to the check engine light. Mr. Alhassan stated that he would make sure it would be fixed. I told him that I was buying the vehicle for my daughter and would be taking the vehicle to Virginia so I need to know if he could fix reasons to the check engine light prior to our departure. He said, "No problem..I will have my mechanic do the work so you have no more check engine light. Don't worry, I will make sure it's fixed. " I again, asked Mr. Alhassan why the check engine light had came on. He told me that it could be the O2 sensor


(Oxygen sensor) and have his mechanic check it. I also told him that if he could fix it and that he put in writing in the purchase agreement I would buy the vehicle. He promised that he would and did write on purchased agreement to fix reasons to check engine light. (see attached purchased agreement). I told him that I would give him 3 days to fix it and come back on 08-16-2011 to pick up the vehicle. He agreed.



On 08-16-2011 at about 4:30pm I stopped by the dealership and noticed above vehicle was not in the dealership's parking lot. I asked an unknown employee if he knows where the vehicle was. Unknown male emlpoyee told me that Mr. Alhassan and the vehicle was at a mechanic shop being worked on. I then told unknown employee I would be back in one hour to pick up my vehicle.


After an hour I came back to the dealership and picked up my vehicle. Mr. Alhassan told me, "My mechanic replace the O2 sensor and plugs, and new brakes. No more light, everything okay. It cost me lot more money.." I then turned the vehicle over and noticed the check engine light was not on at the time. My daughter then drove the vehicle home.



After we got home from the dealership the purchased vehicle did not leave my drive way until 08-18-2011. On 08-18-2011 My daughter drove the purchased vehicle to Virginia. I followed her with my truck. While we were driving through Indiana my daughter called me on the phone saying that her check engine light had came. I then told her that we would stop in Seymour, Indiana and I'll have the vehicle checked out in the morning.



On 08-19-11 at 11:47am I then went to AutoZone in Seymour, IN and had an employee scan/trouble shoot the vehicle. The AutoZone employee then said he would print me a copy of the reasons why the check engine light was on (see attached copy of the AutoZone troubleshoot receipt).


The AutoZone employee advised me that the scanner showed cylinder 1 miss firing and other issues. He said he could clear the code but the vehicle would need to get a better look by a certified mechanic. I told him I would as soon as we get to our destination. While the car was being scanned I did noticed that a new coil on cylinder was replaced. I was unable to verify if any of the O2 sensors were replaced or not.

My daughter and we continued on our trip to Virginia. As we passed Knoxville, Tennessee my daughter called me on the phone and told me that the check engine light came on again. I told her that we would drive through and have it check it out later, but asked her to listen to odd noises from the vehicle.



On Saturday, 08-20-11, as we got near Bristol, Virginia I looked back and noticed my daughter's vehicle slowing down. I then saw smoke coming from the bottom of vehicle's engine. We then pulled over on the highway. I asked what had happened. My daughter said she hard a big bang and then noticed her vehicle slowing down. She said she saw smoke coming from the engine compartment. I then check the engine compartment and noticed heavy oil splatter. I also noticed that there were several pieces of what appeared to be aluminum cast parts all over the roadway. I further checked the engine and noticed that the engine had a small hole near cylinder 1. Tow wrecker service later brought the vehicle to a Toyota dealership in Bristol, VA. While at the Toyota dealership, the mechanic advisor told me that he would have to get back to me on Monday because they were about to close for the day. My daughter then got in my truck and we continued to Danville,Virginia.



On Monday, 08-22-11 Toyota of Bristol called me and told me that his mechanic looked over the car and believed that one of the cylinder rod had broken off and broke through the cylinder block. He said the Scion engine are well built and shouldn't have had any problems if the vehicle was serviced correctly. I then asked if info from the troubleshoot from AutoZone could have caused the engine to blow out. Mr. C said it could possibly because it was near cylinder 1. He then advised me to contact the dealership where I had purchased the vehicle, since it had only been a few days.



I then called SNO Auto Sales, LLC and spoke to Mr. Alhassan. On the phone I advised Mr. Alhassan the situation. At first he asked why I didn't call him right away. I told him that we were out of state and plus it happened on the weekend. I then asked if he would help pay for half of the repair, which was $4205.00. He said, "Don't worry..I replaced everything on the car and shouldn't have any problems. I sell you a good car..I do good business I will help you pay half.." I told him that the car was now in Bristol, VA and do have a problem. Mr. Alhassan later asked that I should take the car to a different mechanic and see if I could get someone to work on it for less then estimated. I told him I could.



On 08-23-11 I then called around and found several mechanic shops in the Britsol, VA area. The lowest estimate was CommonWealth Car Care. Mr. R.C. from Commonwealth Car Care told me that he could replace and repair the car's engine for $3,600. I then called Mr. Alhassan and told him what I had found out and got a lower estimate. Mr. Alhassan agreed he would help pay half of the cost of replacing and repair work. He asked that I send a copy of the invoice from Commonwealth Car Care to him. I then called Commonwealth Car Care and asked Mr. RC to send a completed invoice to SNO Auto Sale, LLC. Mr. Crabtree said he would after he order the engine. Mr. Crabtree said he would call me when he complete the work. I had informed Mr. RC regarding the entire situation with the dealership.



On 08-30-11 Mr. RC called me and said he has to order a newer engine because he had missed out on the original promised engine. He said the price would only be about $100 more. He said the engine would have the same warranty but from a newer year and less miles. I then called Mr. Alhassan and told him about the newer engine. Mr. Alhassan agreed and said he would pay for his half. I then called Mr. RC to go ahead with the order and that Mr. Alhassan from SNO Auto Sale would be in contact with him for payment arrangement.



On 09-23-11 I called Mr. RC and see if Mr. Alhassan had made contact to pay his half. Mr. RC said no one from SNO Auto Sale or Mr. Alhassan had called him. He mentioned that a certified mail with the invoice had been sent to SNO Auto Sale. I then called Mr. Alhassan and asked him why he did not call to make payment arrangements. Mr. Alhassan said, "Have the mechanic send me the invoice first." I then told him that if he does not believe me he could call Mr. RC directly. Mr. Alhassan said, "I don't call..Not my problem." I then asked why he is now denying to pay for his half of the repair cost as first agreed. I told him that I rather not take it to court. Mr. Alhassan said,"I don't care..take me to court.."



On 10-10-11 I called Mr. Alhassan at (414) 243-0816 and left him a message. I again, later called SNO Auto Sale (414) 294-4700 and left another message fro Mr. Alhassan to call me. No return call from Mr. Alhassan. I then later called the SNO Auto Sale phone number and spoke to Mr. Alhassan. He told me he was not going to pay for the repair because the invoice didn't look right. I told him he could call Mr. RC directly. Mr. Alhassan repeatedly said he don't call and it's not his problem. He then said if I want to I can take him to court and then he hung up on me. Later on the evening I then called Mr. RC and advised him the situation. He said he would send me a copy of the invoice for my record and he would wait for payment when this is settle.



I contacted Wisconsin DOT dealer complaint who investigated the issues. According to the investigator, Mr Alhassan only admitted to paying up to $1,000 toward the repair. He even told the investigator the car was worth more than what I paid for..Remind you it was a 2007 Scion TC with flood and salavage title. He said it was worth $10,000. So it was his story..Any way, Mr. Alhassan now claims he never agreed to help pay, even his, half of the repair. In this deal, both, of us are loosing and I'm willing to take the lost. But apparently, SNO Auto Sales believe lying is a faithful way of doing business. We'll have to let the court decides.
