My roommate and I shared a condo. The lease was in only the roommates name, I was listed as tenant with the Assoc. that I live in. My roommate relocated to another state, Crimaldi's said I can take over the lease. They needed the $65 app fee, which I completed. Crimaldi's informed me that my former roommate needed to sign a move out form and I needed to sign a move in form. Which we did. While I was in their office signing the paper, I ask for a copy of the lease. I had never seen the lease and had no clue what the details were. My former roommate signed all paper's by overnighting the move out form. 1) Crimaldi's said for weeks that they did not receive the faxed signed form. My former roommate continually faxed and received confirmation that the fax was sent. 2) I paid the $65 app fee and requested the lease. To this day I have not seen or signed the lease. 3) I stand to lose the last month rent and deposit $2500 4) I paid this months rent withholding $350 dollars and had overnighted for signature the rent minus the $350 along with a letter demanding the lease. 5) I received a voicemail from Crimaldi's saying they emailed my the lease. I did not have it in my emails again I informed Crimaldi's I demand my lease (which doesn't even contain my name because they refused to let me sign it, saying they had to wait until they received the signed move out form from my former roommate. Crimaldi's said they would mail it out as soon as all signatures were received. 6) I continually emailed and made calls that went unanswered and unreturned. 7) I sent an email and a voice mail demanding the lease be sent certified mail. 8)I returned home 3-11-11 to find that they had inspected my condo (which reeked of cigarette smoke) left me a threatening letter stating they will file eviction process on 3-14-11. I did pay $300 and am holding the $50 until I receive the lease. I was never allowed to sign. 9) I delivered another letter attached to the very first letter dated 3-1-11 demanding the lease. 10)In the threatening letter they also stated I would have to pay a "late fee". The letter I left in the overnight box at Crimaldi's office, I stated that I would appeal the evictions on the grounds that I have never signed or received a lease. They have my $2500 I know the would love to keep. I am curious to know how many tenants last months rent and deposit they have kept. I bet it is substancial. I refuse to be evicted. I will be calling an attorney today to seek legal council. I have tried to get a phone number for Joe Crimaldi who seems not to even exist. Today I will call the Attorney General and report the negligence and refusal to give me my lease. I am living in the condo, my former roommate and I moved in June or July 2010 (not sure of the move-in date), I do not want to move. All I want is my lease. My thought of withholding a very small portion of the rent was to motivated Crimaldi's to send me my lease. I have no idea how the lease reads and the date that it expires, June or July. I have no idea if I am obligated to pay a late fee because I never signed the lease, that I have been trying so desperately for over a month to do. |
