Account # 1548213112 I sent Rapid Recovery a letter for them to validate this debt, however, they have not responded with validation or verification of the debt with any witness under oath, who can claim first hand knowledge of this debt. They have not shown that I have a written agreement or contract with them, the collection agency. They have not shown that they paid consideration for the assignment of this debt from Deseret First Credit Union. Without any consideration paid, there can be no contract between original creditor and collection agency. Rapid Recovery has not shown me the contract between Deseret First Credit Union in writing between the two of them to validate that they have any rights of collection or rights of assignment. I did not agree to any assignment to Rapid Recovery of this alleged debt. Rapid Recovery has no contract with me, so they are illegally trying to collect on a purported debt as an interloper. Banks have insurance that apply to cases like this where an account has been written off & closed. The collection agency has not disclosed to me of any insurance claims or the amounts applied to this account, which would pay towards or pay off this alleged debt, due to the account at Deseret First being involuntarily closed and written off. Rapid Recovery is violating the law as the original alleged debt was $361.00 according to my credit bureau report. Rapid Recovery is trying to collect $409.00. It is illegal to add fees that are not authorized by a written contract which is what they are doing. I am also filing a complaint with the Federal Trade Commission for their deceptive trade practices of adding illegal fees not authorized by any contract. I have damages in excess of the purported debt since Rapid Recovery is sending untrue statements to the credit bureaus on the amount purportedly owed, thus injuring my credit rating, and violating the Fair Credit Reporting Act. I am willing to settle my claim if the negative reporting by Rapid Recovery is removed from my credit reports and the debt is zeroed out.
