I went to apply for an apartment and had my credit denied because On-Site.com claimed that I had a forced eviction or Judgement for unlawful detainer/possession against me. And, in order to take this off of my file and change the denied to accepted, I would need to fax them a court order showing the judgement against me was vacated/dismissed. It seemed an easy enough solution. I spoke to the apartment manager and also to On-Site.com manager Kathy Kirkpartick and I was informed that they do not run a regular credit check the same as if you were buying a car, house, etc. They get their information from second hand resources. It also says on their web site that the information they obtain on you may not be true or factual. In other words, the report they obtain on you does not guarantee the accuracy or truthfulness of the information as to the subjection of the investigation (on you). But, they claim that it is accurately obtained from public records, which they do not say from which public records, and the information they claim to copy may be inaccurately associated with the consumer who is subject of the report. I have check my public records at the county recorder and they have no record of any judgments against me. Explain that one On-Site? You can read this information under their own sample reports that pretend to look like real credit reports for yourself. I do not understand why apartments just do not simply obtain a full credit screening from Experian or all three agencies? Why use this second hand screening agency that is not copying/obtaining and reporting accurate information which is like having to go to hell and back to make disputes, unlike disputing with Experian/Transunion/Equifax which is beyond me? This is a good way for this company to lose a lot of potential good renters such as myself. I was told they get their information from Experian. I belong to a credit reporting agency so I am able to view my credit report in full detail. There is a special heading called Public Records on everyone's report. It says 0 reports on mine under public records. I also contacted the credit agency that I am with as well as Experian and again, 0 reports for any judgments, bankruptcys, etc. , nothing. I was involved in a civil case 5 years prior and there was a judgement but it was immediately vacated against me withing 5 days literally. I have all the court documents to prove it. It was filed against me fraudulently, that is way it was vacated so quickly. I had a good lawyer on the case and I won a judgment in the end. I not only faxed the vacated judgement against me but, also faxed other court paperwork signed by the judge just in case to back up any evidence to support myself. I was then told by Kathy Kirkpatrick that this was not sufficient and there was a filing, just a filing not a ruling against me nor a judgement for possession. I again, faxed her the court paperwork showing that the filing was returned to the party and the vacated judgement still remained in effect. I also faxed her court paperwork showing a court order from a superior court judge that the party who tried to get the judgement reinstated was ordered by the judge not to attempt to file or attempt any more evictions until our lis pendens was final and that the vacated judgement was to remain in effect. When you are in a litigation, all property is frozen along with all actions until the litigation is over and judge decides who property belongs to. I won, and I faxed the judgement in my favor along with many other supporting documents. But, nope, again not good enough. This prevents me from getting into a cheaper apartment from the one I am in. I did not have a problem getting into this apartment I am in now, got lucky I guess but applied for 3 others and they all go through ON-SITE. What a waste of my money and time. I can not afford to rent a house because most of them want a high deposit versus an apartment and I tried to get two rooms for rent for my 16 year old son, 1 cat and myself, but to no avail. Many people do not want children or pets in their home. Going to a hotel/motel is also too expensive, pretty much the same where I am at now. The apartment I was trying to get into was $250. cheaper than where I am now. This could of helped me greatly. I have a severe disability and can only work part time so my income is limited and this whole episode has put me through so much undue stress. I am reporting this company to just about any agency such as, Fair Housing Act, etc. and also will be suing them. When your credit is being reported to the point that is causes certain damages to character, credit and causes emotional stress, along with whatever else I can think of is defamation hopefully. I am at least hoping the judge after seeing my court documents and hearing my case will order on-site to take this damaging information off of my file. I will also file to force on-site to bring all their resource documents; where they are truly getting their information. I talked to someone in their marketing department and they informed me that they get their information from Experian, your credit score maybe, but that is it. I have performed some research on this company and they have only been in business since 2009 although, they claim to have been established since 2001, I believe they are fairly new. I requested to speak to their so called legal representative which they call an on site lawyer but nope, no can do. Well, wish me luck in court, and if I win, hopefully this will help open doors to other applicants who have been turned down for no real legitimate reason even after they have proved otherwise. Documentation speaks the truth. |
