In Sep. of 2010 I called my lender, Ocwen Financial to let them know that I wanted a loan mod.to have my housepayment lowered.I was recently quite ill and now Handicapped.I am unable to work full time and wanted to be proactive and let them know that the payment was too high.I was routed to a call center in India,and promised that I had qualified for The Making Homes Affordable Program.They sent me a packet to fill out.I was told that during the process of the loan mod.no foreclosure proceedings would be started.I received the packet and filled it out that day.Faxed it back with needed paperwork.Did not hear from Ocwen for several days so I called them.I was told I was missing papers and needed to send them so loan mod. could be finished.I was also told NOT to make any housepayments during the time they were working on the loan mod.because it would make things difficult.I sent them papers again and wondered why I should not pay them.I was up to date on my payments at that time,and didn't want to fall behind.This process of faxing and faxing and faxing the papers over and over again to Ocwen happened over 10 times.It was now 2011 and I was getting nervous about falling behind more so I sent in a payment through their website.The payment was not ever acknowledged or debited from my bank.I had some medical bills come up during that time and had to pay them so I did.I called Ocwen and again got someone in India.It was always India or Africa where their call centers were.That worried me.Again the person told me; and I have all names, that they were working on my loan mod, not to worry about foreclosure;even though my monthly statement said the property was in foreclosure and that they will help me.I was in tears.I'm disabled and needed their help.I contacted a friend whom I gave permission to contact Ocwen in my behalf.She got the same treatment.She faxed and faxed and faxed in my packet until she was blue in the face.Nothing got resolved.On June 1st,I received a notice that there was going to be a trustee sale on June 9th. I panicked.I am on oxygen and it is very hard for me to breathe when I am upset.I called my friend and she couldn't believe that they were doing this to me allthe while telling me they were working on the loan mod.They were lying through their teeth.On June 9, I looked at the Ocwen website and was surprised to see a note saying that they were working on my loan mod.and it was taking time because they needed certain paperwork faxed to them.I printed out the note and drove to San Bernardino.I located the person in charge and showed him the note and explained what Ocwen was doing to me.He told me that Ocwen has more trustee sales than any other lender he knows of.Plus,they were not even a lender, but a servicing company.He told me to wait a few minutes and he'd be back.I waited.When he returned he called me over and told me that the Trustee himself, and he made it clear that it was the Trustee himself who said to postpone the sale and that I had until the 14th of July to get Ocwen in gear to get the loan mod.finished. I was in tears.I went home and told my friend what happened. It was not until July 7 that I found an envelope on my front gate.A plain white envelope.I opened it, and inside was a form letter from a company saying that the new owner of the property wants to gain access to it.It said that Ocwen was prepared to offer me cash for keys and I had to call the number on the form letter by July 8.I went inside and called them.Talked to a nice woman who told me that, after hearing about my situation said that I probably would not agree to their offer.Their offer was 1033.00 and I had to be vacated by July 18th or they would start to evict me.Me, handicapped and unable to move livestock and pets to a location that I had not even found yet.I was told that she would call me the next day to find out if I wanted to accept their offer or not.That call never came. I called Ocwen again and was told that my house was listed in the REO department.I asked what that meant,but was told they had to transfer me.They attempted to transfer me and I was disconnected.This happened 6 times!The next day I called Ocwen again, and asked for the REO dept. but I wanted their direct number.They gave it to me and I called.A gal answered who seemed nice.She explained what REO meant,but said that she could see in my files it had taken Ocwen a long time to work on the promised loan mod.I was told that I should not worry, there was still time and that she would talk to her supervisor and they would certainly help me.She asked if she could put me on hold and I agreed.She came back on the line and told me that her supervisor wanted to talk to me.I asked for the name of the supervisor and was told she was unable to grant me that information, just to wait for her call.She said she would keep in touch via e-mail and so would her supervisor.Two days and no call came.I called Ocwen and again was transferred to the REO dept and disconnected.Then the phone rang and it was a woman who identified herself as the head supervisor.She told me that she had a meeting with other supervisors and it was decided that a loan mod. was not for me.That they had not even started working on one.I was livid.She did mention that she would ask for more time for me and more money for moving.
My friend did a title search and found out that my home had transferred to HSBC Bank on June 21
for 120k. June 21??? I was supposed to have been given more time by the Trustee himself!! Plus, I was NOT notified that there was another trustee sale on my property.In fact,I was NOT notified that the property had been sold at all. I called HSBC Bank and was told to contact Ocwen, that they still owned the property.I am so confused now my head's spinning.
I am disabled,on oxygen full time,have an electric wheelchair and they expect me to move out of 5 acres in a few days??? This company,Ocwen, and everyone attached to them should be brought before the Supreme Courts and fined within an inch of their lives.They seem to like kicking people, especially handicapped people out of their homes.
I am trying to find out how to join the class action suit against Ocwen, and any information you may have would be greatly appreciated.I am terrified I will end up on the streets, and because of the lies and false promises about a loan modification they moved in like a shark and took my home away from me. From what I am reading here in scam Report, they have done the same thing to many others.We should all get together and sue them.That is really important. We should do that.
