I have been going round & round the mulberry bush with these scam artists extraordinaire. Let's start with the fact that I'm no online newbie, health problems prevent me from traditional shopping, so I wind up doing a lot of Internet purchasing, & rarely have had any issues. Of course, I mostly stick to Amazon Prime items, or other large retailers. I was searching in early December 2011 for a North Face jacket from last season, a hard to find item. I finally found it on "North Face Packs".com. The site *seemed* on the up & up, the prices were similar to regular North Face items, no big, deep discounts to give me pause. The jacket arrived nearly 2 weeks later, in a plastic envelope that had seen better days. I knew when I saw the packaging that something was WRONG. Upon opening the package, it was discovered the wrong jacket had been sent, a men's jacket not even similar to what I'd ordered! I immediately sent an email to the site, using their "contact us" form. They replied with apologies, asking that I take pictures of the jacket and email them, which I promptly did. Their reply was LUDICROUS: "Thank you for your photos! We have confirmed this issue with our dispatch department. The manager of our dispatch department has investigated this issue and told us that they did send you the The North Face Novelty Osito Fleece Jacket - Women's. However, the express company made a mistake. They sent the other's order (black Men's jacket) to you and sent your order (Women's North Face) to others. We have negotiated this issue with the exprss company. They said they were willing to give you 10% of the total price as compensation. As a sincere supplier, we won't let you down. Since you are the first time to do business with us, we really appreciate your business. Thus, we will also give you 10% of the total price as compensation. That is to say, you will get 20% of the paid amount refund as compensation. Hope you can offer your strong understanding! Best regards!" WOW! Strong "understanding"?!?! Ha! So now the shipping agent is responsible for selecting which items go in what package AND slap the labels on them? UPS, you better get with the program! LMAO. I replied that this was OUTRAGEOUS, that you cannot send someone the WRONG item AND expect them to pay for it! Their next entertaining reply: "As a sincere supplier, we kindly suggest you keep the jacket (you received) and don't send it back for exchange. It will lose much money not only for us but also for you if you return the jacket for exchange. On one hand, if you return it for exchange, we have to pay a high tariff. On the other hand, as a rule, if you return the jacket for exchange, you have to pay for the return postage and the resending shipping fee which will cost you nearly 60% of the original purchase price. That will be nearly enough for you to buy a new one. Most importantly, you should assume the risk of loss of goods due to the international transportation. If we don't receive the jacket, we can't make an exchange with you. So all in all, we recommend you to cancel sending the jacket back to us. If you don't like the jacket you received, we kindly suggest you sell them to your customers or give them to your friends/relatives who fit for them as a gift or auction the unwanted jacket on eBay. We will try our best to reduce your lost. Thus, our manager has agreed to refund 35% of the original purchase price to you as compensation! Hope you can offer your strong understanding. Best regards!" WOW AGAIN!! So, THEY sent the WRONG item, but THEY don't want to lose any money!!! On a counterfeit at that! (which was discovered immediately upon opening the package). Gee, what about MY money?! So, it goes on, I carefully explain to them that they cannot expect to keep any of my money since they admittedly sent the wrong item, that I know shippers do NOT pull & package products for them, and that I expect a full return and shipping credited back, requested an address to send the jacket back to (again), & then their next reply: "Dear friend, I am really sorry what happened. You are right,we have the responsible to undertake the mistake. But it's not all our fault.Like i said, the express company made a mistake, sent the wrong jacket to you. Besides, we only can refund 35% of total price to you due to the bank has charged us 20% of total price as handling fee as soon as the transaction has been completed and the freight charges which cost us 30% of total price. We try to compensate you. If you insist on returning the order to us, you have to pay for the return postage which will cost you a lot. Besides, you should assume the risk of loss of goods. If we don't receive the goods in a saleable condition, we can't refund the payment to you. So, I kindly recommend you to keep the jacket and we refund 35% of the paid amount to you as compensation. Then both of us can reduce the loss. It is really a win-win solution. Hope you can understand it! Best regards!". Yes, it's funny reading. But $115.02 was charged for a wrong item, which they refuse to refund, credit, or exchange. BAD BUSINESS FOLKS, REAL BAD. I know this is against The Law here in the U.S., but internationally? I'm guessing those are trickier waters to navigate. The company states they are in the U.K., billing came out of California, but they're actually in SHANGHAI. If I would have taken the time to read their return policy, etc. I would have had several RED FLAGS go up all at once: "We guarantee prompt shipping once the orders are placed and payment is transferred. And the tracking number will be emailed as soon as the goods are shipped out. However, we cannot control the status of your shipment after it leaves our shipping department. Delays may be caused due to weather issues or other circumstances beyond our control." Uh oh, not responsible once it leaves them? Uhh, yeahhh okaaaay then. Or, this: "Your return should contain the undamaged box and original packaging plus any accessories or extras that may have been included along with the shipment. Your return should be packaged in a protective box for shipping. Items returned with postage stickers on the original box will be considered worn and will not be refunded. Only apply your shipping label to your protective box and NOT the box. If your return is sent to us without a protective cardboard box, we will not be able to accept the return." HUH? If there's no postage "stickers", how will it reach them? They state you have to reuse original packaging, but IF I use the original plastic packaging, it will be refused because it's not in a cardboard box, which must also be used? Talk about double talk! This is obviously a SCAM, they most likely send EVERYONE the same "wrong order" (non conforming goods), and then hope that most people won't pursue it or them. Not me. I wouldn't care if it was only $5 in question. Retailers can not send you the wrong item and expect to keep your money, regardless what their return or exchange policies are. Bait 'n switch anyone? It's a double scam you see, first- it's fake, a COUNTERFEIT. Second, it's the 'ol bait 'n switch and hope it's too much hassle to be pursued. However, other than having my bank issue a chargeback (the process has already been started mind you), I'm not sure what else I can do. If anyone has suggestions I'm all ears. I'm really disgusted both at myself and them. These kind of web based international businesses need a sort of U.N. Better Business Bureau service to protect consumers. I will keep going round with them, even though I KNOW I won't get ANYWHERE. I figure if I just keep at them & be a pain in their back side that it will cause them a little portion of the aggravation they've purposefully caused me. In the meantime folks, STAY AWAY FROM NORTH FACE PACKS!!! Unless, that is, you wish to pay full price for a counterfeit AND have the wrong item sent. Class A Scum Sucking JERKS!!! |
