Move, Inc. and its affiliate for failing to: create, maintain and publish advertisement in accordance to the signed agreement. On July 8th, 2010, I hired Move, Inc. to create, maintain and publish advertisements on behalf of Graystone Realty Group, Inc. All content and required authorization were submitted in harmony to Move Sales, Inc. Terms and Conditions. On July 12th, 2010, I was contacted by a representative of Custom Creatives to discuss the advertisement details layout, content and images etc. From July 15th 29th, 2010, I had to address many issues with Custom Creative regarding spelling, grammar, capitalization, logo, links etc. July 30th, 2010, Mark Wasserman, Leo Jay and Custom Creatives decided that the advertisements should be published even though all edits were not completed. Immediately after receiving the email form [email protected] addressed to Mark Wasserman, Leo Jay and Graystone Realty Group, I called Mark and informed him that the advertisement was not ready to be published as it has many errors and broken links. Mark stated that Custom Creatives would continue to work with me to ensure all necessary issues are resolved. August 3, 2010, [email protected] emailed Mark Wasserman and me stating they have completed the requested changes to the banner and required my approval. I called Custom Creatives design team to notify them that the changes we previously discussed were not addressed and other pending issues had resurfaced. August 10th, 2010, [email protected] contacted Custom Creatives requesting they load the advertisement without addressing my concerns from August 3, 2010. On August 13th, 2010, I left Mark Wasserman a voicemail stating I would not be making a payment until the agreed upon issues were resolved and completed. I also stated that I would appreciate it if he would return my calls and emails. Neither Mark Wasserman nor Custom Creatives responded to my numerous phone calls and emails from Mid-August to Mid-November. November 10th, 2010, almost 4 months of calling and emailing I finally got ahold of Mark Wasserman to discuss the required changes and requesting that Move, Inc. provide timely service for which I am paying for per the contract. Rather than resolving the issues he suggested we change from buyers assist to the Featd Comm. Companion. November 16th, 2010, I received confirmation of the changes to my original order along with notice that my 12 month agreement ending July 7th, 2011, had been extended to November 16th, 2011 and the design team from Custom Creatives would contact me to prepare the advertisement. I immediately called Mark Wasserman to let him know I would not commit to the extension in the contract. I suggested that he revise the contract to reflect the appropriate terms and duration for me to review and sign. Mark has yet to return my call/email or provide me with a revised contract. December 16th, 2010, I am contacted by Corina Thomas from Move, Inc. requesting payment regarding invoices for September and October. I explained the situation to her and asked that she request Mark Wasserman or a manager to contact me immediately to rectify the situation. For the next 8 weeks I would leave messages and emails for Move, Inc., Mark Wasserman and Custom Creatives requesting they contact me to resolve this issue. Rather than receiving a call/email to address the matter, Move, Inc. canceled our services and referred the account to a third party collection agency, which will negatively impact my personal and company credit. Move, Inc. employees and affiliates at this time have still not created, maintained, and published the advertisement in accordance with their contract and know feel they they have done no wrong and are not willing to remedy the situation. |
