In May 2009, I moved out of my home in Stroudsburg due to the intolerable conditions of living with my husband. I asked my children (who were both under the age of emancipation) to move with me; however, this meant moving out of their school district and they, unfortunately, did not give me their decision to remain at home until after I had moved out. I moved back home in late July 2009. During my brief absence from my home, my husband hit me up for child and spousal support. I was working in NYC at the time and made a decent wage, which in turn, spelled a good income for my husband. I was paying him almost $2100 a month - I was in the middle of a mortgage modification with my bank and neither he nor I were making any mortgage payments at the time (which had been $2300 per month until then) so, with his $1000 monthly income from his part time job, my $2100 support and spousal payments and the $70,000 he had just received from a negligence suit, he was doing rather well for himself. He bought himself a new bedroom set and several cars yet never got around to having the house painted nor new rugs put down like he promised the kids he would do after I left. I paid the support and, like most people, began my support payments already in arrears. In August 2009, I applied for a support modification and was given a hearing in September 2009. At the hearing, I explained the living situation which caused me to move out, asking my children to move with me. When they decided to stay home, I returned home to live with them. My request to modify the support was denied since the mediator couldn't decide where I was living (although all my mail and my driver's license clearly read my home address). In October 2009, I again applied for a support modification (since I was still living at home) and my hearing was set for late December. And again I was denied because the mediator...just decided I should keep paying. No real reason was ever given to me. In February 2010, I lost my job in NYC and began receiving unemployment in March. In April, I applied yet again to modify my support payments and my hearing was set for July. Although my older son was now emancipated and the spousal support ceased, I had to continue to pay support for my younger son - while I was STILL living with him. So, again I was shot down. The reason? I'm STILL not sure. At the end of the hearing, I paid $50 to have my case heard before a judge. The hearing was set for September. I (and my husband) had our say in court and after waiting about four weeks, I got the judge's decision. I not only had to continue to pay support, he increased the amount I had to pay to cover medical insurance and to start paying down the arrears. No reason again was given to me. And I was living at home the entire time. Is it me or are these people stupid?? There is not a single person I have spoken to who thinks I should pay this man one thin dime. I've supported him, my two sons, a residence, bills, etc., etc., since my oldest son was 3 at which time my husband decided to be a stay-at-home dad. Enough is enough already. I don't mind supporting my children, but why this man? And why were my modification requests shot down every single time? |
