We had some financial issues with the complex birth of our child. We got behind on our mortgage. We contacted our mortgage company and they said we could modify our payment which would also roll our behind payments into it and would be easier to get back where we needed to be. So we faxed all they asked us to fax and waited. We got a letter in the mail on october 1st saying we had to sign and return the form with payment by october 1st otherwise the deal was off. We were unable to comply with that as we physically opened that letter after it was too late to do get it postmarked in time. We did it anyway in hopes they'd understand they set us up to fail and not hold it against us nothing was done until october 2nd. They did not. They said we were one day late and the deal was off, however there were other options available. They said they would return the check we sent since it wasn't a full payment, it was a modified payment. They lied. We then set up a payment of a full months payment to keep us above water via telephone. It was to be taken out that friday. They took the payment as well as posted the check they claimed they'd return. So then we were also in the hole with the bank. We again faxed all they asked us to fax and waited. They said they'd know by the friday before christmas. We kept calling and calling and no answer yet. Finally by Wednesday they had told us after we've been calling every day we were denied. And that they were beginning foreclosure on january 25th. We wont lose our home. We will find a way. They wont get the best of us. We've kept thorough records opf everything as well as have a video/audio recording of phone calls. Once we get caught up we will contact a lawyer and see what they say. I find it ridiculous they set you up to fail and then pounce. Something needs to be done about these people... I've researched and found this has happened to many. Maybe we should all pitch in and sue them. |
