We signed a contract to build a pool from scratch in october of 2011 - Before that we had gone to the showroom numerous times and had received a quote. When the time came to sign the actual contract, the length of construction and the payment details were different than the quoted contact. I brought this up and they said it was new company policy. We were given a sales pitch stating that they always complete the work and that it would verbally take 4-6months and to be patient. At that time, we also made an agreement that we wanted certain materials and they stated it would be ok and we could discuss it at the phase of work. Skip to November 2011 - We had not heard from them and finally contacted them - They stated they had left numerous messages and emails to us asking us for updated surveys and until that was completed permits could not be done. First we heard of things they needed from us. We obliged. 3 months later the permits were not pulled yet, since they had issues with the person building the plans for them - we went through 5 different rounds of plans giving us mutliple excuses throughout the process. Here is where it gets better - It came tiime to dig the hole. They stated that they needed cash upfront per the contract to start the work or they would move us to the back of the line - I wrote on email stating that the contract states that payment is due at completion of work. Owner replies that the addendum is the document for payments which states before. The contract states that payments are made at time of work completion, but the adendum which is what they keep referring to you states they will not start work until payments are made. After more arguements we decide to make the first payment- They did not start digging the hole until March - at this time the subcontractors they hired destroyed the pavers we had in our front yard (FRONT YARD NOT BACKYARD). They stated they are not liable for any damage and would not correct the issue as per the contract. I then started saying that the addendum was the document at hand not the contract as per your payment schedule etc and no where on there does it say damage is not covered. More arguements insue. During this time we try and cancel the contract and they state that we would be liable for the completion of the pool and they would not remove the lien on the property etc. We had to make another advance payment for Concrete and it was not poured for another month after they cashed the check as they stated they could not find the concrete driver (real reason as per concrete company that came, was lack of payment). Once Conrete was poured we recieved a lien notice on the property due to lack of payment - We requested they pay them and provide us with an invoice - this took over a month. At this point we had reached the 6 month time frame in which the pool should have been completed. Concrete did not look right and they stated it was done to plan. (new contractor states that it is done wrong even though it passed and somework is now done to fix the entrance) Once the concrete passed inspection, it was time for plumbing and electrical. Let me just say that the electrical failed 3 times and has still not completly passed. This phase has taken over 5 months and we were threathened to be put at the end of the list if we did not make payment for tile and coping immediatly. Here is where the bait and switch tactics came into play- at the time of the contract they had told us travertine was part of the price (its on the plans). Now we had to write an additional check since they said they never agreed to it. Not only did that happen but it was now 3x more than the original amount. That payment was made in August and materials have yet to be ordered or monies refunded. Fast forward until today December 13th - We recieve a call from the project manager since we keep sending emails stating that Friday is the last day for all employees - The store is closing. We are out $12K for materials and we are not the only family in the same boat. The new estiamte to complete the pool is 24K. We believe they have formed a new company and will continue to scam people as they had been receiving funds until last Friday knowing they were going to close. We are working through an attorney and filing civil charges and looking to file criminal charges - These people need to be stopped |
