1/28/2011, I entered into an agreement with Jeff Herrington and MBC Construction to perform remodel and room addition to my home. The mutually agreed contract was for $155,037.07. The contract provided a detailed job description and specified progress payments as the method of payment. Jeff Harrington quoted completion at four to five months and agreed to provide professional workmanship and job site supervision. Additionally, he agreed to protect my property and provide general liability insurance should there be a problem. Mr Herrington provided incorrect material by providing incorrect sizes, lengths, and quantity on five occasions causing weeks of delays and need for numerous corrective repairs. He rarely visited job site allowing additional errors and failed to provide the promised attention and care he promised when hired. The last progress payment request for payment he billed almost $30,000 and was paid approximately $20,000 by check and $9000 cash per his request. My book keeper Tina Figueroa, wrote check and witnessed his cash request payment. Additionally, she had him sign his bill as paid in full for all services thru the date paid. Jeff Herrington gladly accepted payment in full per his request but did not in turn pay suppliers and subcontractors. Additionally, he placed a stop payment on check from him to our masonry contractor who provided services in the amount $5368.00. After making payment, I was no longer able to reach Jeff Herrington by telephone or email. I left numerous voice mails with no return calls and sent five emails with only one response promising that he would return to work. He never returned to work nor did he protect home from water intrusion and the June rainstorms destroyed much of the new materials and caused extensive water damage within the home. He was sent a certified letter that he received with his signature confirmation yet he has not replied to me nor made any payments to the subcontractors and suppliers. Jeff Herrington billed for services he didn't provide. He was paid for services billed without conveying payment to other parties that he contracted. He failed to provide adequate job site supervision and protection of my property He abandoned my job site leaving me with significant losses and potentially forcing me to pay subcontractors and suppliers twice. |
