Cynthia and Ellsworth Brown who are retired and in their 70's were very concerned of their mortgage payments which have always been paid on time, became increasingly difficult as they had a variable rate mortgage ad the payments has crept from 1200 per month to over 1600 per month and found themselves using credit cards to buy groceries with.
Mr Burgis Sethna, a financial professional from NYC was visiting my office and understood the problem and recommended his associate Mr. Douglas Helkowsky of the Brett Margolin Law Office as an expert and a close friend who could certain assist my mother with this difficult problem.
Mr. Helkowsky was seemingly concerned and understood the complexity of trying to negotiate with the Mortgage companies and advise to have him professionally handle the case.
We were asked for an initial retainer and to agree to pay subsequent payments until the total of $2250.00 was paid for their services.
We were told by Helkowsky that LEGALLY he cannot tell the clients to NOT PAY THEIR MORTGAGE PAYMENT.
He advised us of this frequently. Fortunately for Cynthia and Ellsworth Brown their pride of being good American's kept them from following Helkowsky's reverse psychology.
A few weeks ago I was contacted by one of Helkowsky's staff and advised to resend to their the same documents as we have multiple times at their request after the initial intake package had been provided.
We continued to receive the letters from the Servicer saying we didn't qualify for loan modification as they were not provided with the proper documents. We again furnished the documents requested to their office and shortly thereafter received word from Douglas Helkowsky that the Law Office withdraws their activity with the Brown file for non payment of a remaining balance of $650.00 Please note the information that we had requested at several times since the process began for some evidence that any progress was being made as we have several letters from the servicer over this time period from April 10 to present stating we didnt qualify for loan mods due to incomplete documents.
When contacting Helkowsky to discuss the case he would tell me that my reluctance to pay is the cause of my mother being foreclosed on and losing her home.
Please note the property has NEVER BEEN in foreclosure and had we followed Helkowsky's reverse psychology statements of "I cant advise you to tell your mother to NOT pay her mortgage payments, The Browns would certain by now have been foreclosed on and lost their home.
The Brown's now seek that the Law Office Of Brett Margolin complete the Loan Modification or reimburse all of the moneys paid to them prior to us taking further action with the NY State Attorney Generals Office and seeking damages form their less than professional activities in this case. |
