I had L&B's do an estimate for some concrete landscape work after seeing them at a trade show in Denver. On 4/10/10 L & B's came to my house and I was given an estimate of $2252 and told if I signed the estimate that day I would receive a 20% discount ($450.40) off the price as a "trade show" discount. And that it would guarantee that price until I was ready to begin the project. When I asked where to sign the estimate he told me I needed to sign a different form since he was using an old estimate sheet and that he would just staple it together for my reference for the estimate and price guarantee. So months and months pass and I would get an occasional call from L & B's asking when I want them to come out and start the project. Each time I would tell them we're not sure and we're doing some different things in our backyard now and that things have changed so we're going to delay adding curb scape to our landscaping plans for now and when we're ready I would call. Then in June of this year (2011), I get a call from L & B's claiming that since I hadn't completed the
contract I signed that I was going to be charged 20% per the terms. I explained to them that what they performed at my home was an 10 minute visit and a written estimate and that they represented the estimate as just that, an estimate... and not some agreement. Never once was I told I was obligated in any way when I signed the estimate or when I was contacted on the phone. They pretend it's a "quote" but what they are actually doing is tricking you into signing a so called "contract". Because of the way the estimated was represented, as a way to "protect" the low price and 20% discount, that this was an attempt to gain my business in a deceptive and fraudulent manner. Most importantly, I was appalled that any company would try to "bill" you for services they never performed. In addition, they have threatened to take this to collections if I don't pay. This bogus claim could harm my credit rating and cause me undue harm. Furthermore the so-called contract I signed included no details regarding the work to be performed, no price, no dates, and no signature from anyone at L & B's. The bottom line is why would a reputable business try to charge someone for work that was never performed?
