My mother recently passed away and I have been reviewing her finances. She kept all of her credit card statements and checking account statements. I know that she had some financial problems starting about 7 years ago. My parents had a good retirement income and should have lived in comfort. I was unaware that creditors were such absolute scum bags that prey on our trusting elderly population. My mother ordered Christmas gifts for her grandchildren and great grandchildren from the JC PENNEY Catalog when her health began to fail so that she was unable to shop. Those scum bags had been haressing her to buy LIFE Insurance for years. This was charghed to her credit card in the amount of $23.44. But that is not all. She was also charged the following : $16.76 for Credit Ins Premium ??? Leisure Plus 6.50 PLAN PLUS 7.50 Accident Policy 15.58 JC PENNEY INS 25.61 LIFE INS 23.33 Finance Charge 55.27 PREVIOUS CYCLE LATE FEE 25.00 This was every month. Her ballance was $2,785.64 and she had made payments totaling $397.00 for that one month. This statement is dated 01/05/2002. My mother filed for bankruptcy in 2005. JC PENNEY. There is no telling how much money she gave JC PENNEY in fraudulent charges and finance charges intrest rate and fees. JC PENNEY went on to get an attorney and a credit service after her. This makes me sick. My mother passed away on August 27, 2010 aqnd my dad is now greiving his self to death. My mother was 83, he is 88. My mother did one smart thing and filed bankruptcy in 2005 after transferring the house to her children. I think JC PENNEY managed to collect from her anyway and when she died she still had her JC Penney account and they were still scamming her with LEISURE PLUS and fees and some other crap. Is there anything that I can do about this ? I feel that she left all of this information behind for a reason. BEWARE FOR YOUR ELDERLY LOVED ONES, FIND A WAY TO CHECK CREDIT STATEMENTS. My mother suffered tremendously. She sacrificed food, medicine and lived in poverty because of predatory creditors after she and my dad had worked hard all thier lives. This took years of her life and made her last years very unhappy and she was too embaressed to tell me or ask for help. Is there anything that I can do about this ? |

Tragic. Thank you for warning others.
They'll get theirs. The company got a new CEO who has insulated the exec offices from knowing of any unresolved complaints. The "forgot your password" feature on their website has not worked in 2 weeks despite dozens of complaints and the best efforts of the "customer care supervisors" to prod IT, but management doesn't want to be aware when a whole dept. (the IT people) is totally dysfunctional. This is how A&P Supermarkets were leading up to their bankruptcy.
They still have much deeper pockets than you so suing is probably a losing proposition, unless there's already an ongoing class action suit against them that you could join. I would focus on your dad, perhaps bringing him into your home so he won't be alone. My sister & I found that hiring help is more humane and less expensive than a decent nursing home (if there still is such a thing since Big Pharma has been buying them up). Make sure he has his favorite music, perhaps rented movies from Netflix, and lots of short visits with him from you and your kids. Your mother wouldn't have wanted him to suffer. Pay a well-recommended accountant an hour's fee to check his finances a few times a year.
Oh, and maybe call your broker and go short on JCP and sock it to the brass' options? |

Found this online: "
A class action lawsuit has been filed by Esther Viola Abrams, against JC Penney Credit Services, General Electric Company, and NCO Financial Systems Inc, alleging that the defendants illegally substituted herself as the debtor on her deceased husband's credit card without her consent, instead of making a proper claim against his estate. The suit is filed on behalf of all others similarly situated."
Along w/ quite a few other class actions against various aspects of the insurance which has been purchased by Conseco. Do a search to see what is happening in your state. |
