I bought a Tomlinson San Diego Chargers jersey from this seller on eBay and it had a small speck of wear on it. I wanted to take it back so I opened a dispute. The seller got on me for not contacting him first. The reason foir that is because half the time I contact sellers they don't get back to me. So the PayPal dispute right away usually wakes them up. I normally don't have many problems on eBay but I recently bought a ton of stuff and ran into bad apples.


Anyways, the seller insanely claimed that the jersey he sent was brand new and wanted me to take pics. I had received so many items in the past couple weeks that I thought I already returned it so I had told him this. Basically to make a long story short the dispute didn't resolve anything. I will reveal the details of what happened below:

I don't accept returns, so an exchange is what I can offer and if the jersey was damaged by you, I will bring this to the attention of Ebay and my local authorities. I didn't like the way this sounded from the start. You left positive feedback, never contacted me directly. What is going on here? I am not going to be taken for shipping and a damaged jersey when I sent you a perfect one.


From Buyer - 11/11/2010 20:26 PST Did you receive the jersey back? This is a $23.98 transaction that you're threatening me over and I don't appreciate it. I don't know what your problem is but I am telling the truth. Why in the world would I damage a jersey? Authorities mean police, they don't even handle issues like that. Making threats to me isn't going to resolve the problem.

From Buyer - 11/11/2010 20:45 PST One more thing, I am sorry that I didn't wait til you replied. I really had no idea sellers would want pics of flaws. The few things I had probs with they just told me to return it so I didn't think twice. I learned my lesson from that. The reason I didn't contact you was because in the past when I have contacted people about something, they never got back to me so I thought opening a PayPal dispute would get it resolved faster. I am not out to scam anybody. I have OCD if you must know and I look at things very carefully. If there's a bit of something worn away like this jersey, I'm not happy about it and it bothers me. I looked at your feedback with toolhaus and that is just shit. So because of those buyers you are accusing me that I'm like them, well you're wrong! Champs would never be like this.


From Seller - 11/12/2010 11:10 PST So, you are saying you got the item, left positive feedback and then days later say it's flawed despite the fact that the pictures of the exact jersey is now somehow damaged? I think you are trying to scam me, without a doubt. My brother in law is a state police officer and before I open the package, I am going to bring it over to him and open it up with him. If I sent you a flawed jersey, and I didn't, I would have gladly accepted it for a complete refund. I know this is clearly not the case and I guess I will have to take the legal route to prove that point. I hate fraud and clearly this is the case.


From Buyer - 11/12/2010 19:15 PST You are not going to bully me. I just found the jersey in my messy apartment and didn't realize it wasn't sent back. I want this nightmare to end though. All I want to do is look forward to Thanksgiving and play Super Nintendo. I'm closing this dispute. There is a speck of wear on the back but I fear I'll lose the claim and you'll have the item. One other note, I talked to paypal tonight on the phone and (PayPal rep's name) agreed with me that you were being ridiculous about taking legal action for a $23.98 item. Hope you rot in hell!

From Buyer - 11/12/2010 19:17 PST The situation wasn't resolved to satisfaction actually but I don't wish to correspond anymore with this threatening seller. He was an absolute jerk and I'm just going to have my aunt resell the jersey. PayPal Note: Buyer confirmed that buyer and seller reached an amicable resolution on this Dispute and buyer closed the Dispute.

So I am stuck with this jersey that isn't as described. The seller acted insanely ridiculous threatening me over something that shouldn't have been a big deal. This is a perfect example of why eBay is a dangerous site to buy and sell on - people like him/her. I was bullied into dropping the dispute and the truth should be told about this jerk. I have pictures added here that will back up my claim. I wouldn't have damaged any jersey on purpose or even accidental because I take good care of them and some are even in space saver bags. The wear was apparent as soon as I received the jersey. It wasn't even shown in the picture. He threatened me with legal action and the authorities. :( I would never buy or sell to this person again and recommend others stay away from him/her too.


I don't wish for people to respond to this report - just read it and weep.
