Sandia Realty & Property Management, LLC contracted with Homerentals, Inc., dba Homerentals.net to design and host a custom Internet website. The staff of Homerentals.net made promises and representations about their product and services, and Homerentals.net clearly failed to perform according to promises made to activate a temporary website, develop and design a custom website, and fulfill the requests of Sandia Realty.The staff of Homerentals.netfailed to follow written and diagramed instructions and the staff stonewalled any attempt to alleviate what was thought to be "miscommunications." Sandia Realty had a third party complete the design of the website, and Homerentals.net still refused to activate the completed website when requested. Sandia Realty terminated the agreement with Homerentals.net when Homerentals.net refused to perform. Homerentals.net required a "Package Contract Cancellation" form completed before refunding the deposit. This form stated, "You have requested your Homerentals.net package cancelled without cause before your contract is up. If money is refunded, it can be released at the end of your contract period..." An attorney advised that the form was unacceptable as the contract was cancelled with cause as Homerentals.net failed to perform, Homerentals.net would not refund the money immediately and may eventually decide not to. Mike Anderson, President of Homerentals, Inc., responded that the deposit would not be refunded and that the balance of the contract is due. Homerentals.net had represented themselves as a corporation, was operating as a corporation at the time and Mike Anderson had represented himself as President of the corporation, however, the Arizona State Corporation Commission stated that the corporation had been revoked by the state of Arizona. A foreign address showed Homerentals, Inc. as a Delaware Corporation at the time, however the Delaware Corporation Commission showed the Corporation as inactive at the time. Furthermore, Homerentals, Inc. did not have a registered agent listed with the New Mexico state Corporation Commission. There had been numerous attempts to determine the status of ownership of Homerentals, Inc., however, the staff and the "President" of Homerentals, Inc. had refused to provide any information. Homerentals.net and their staff acted in bad faith, misrepresented their products, services and business entity. They had falsely advertised their membership in the Better Business Bureau on their website, contrived fictitious charges and refused to refund the $440.00 deposit. The months of stonewalling and failure of Homerentals to perform occurred at a crucial start-up period of the business. In contrast, after terminating the contract with Homerentals, Inc, Sandia contracted with Advanced Access, who set up a beautiful website within 3 days of request. I had received many compliments on the website. I highly recommend Advanced Access to anyone selling and leasing real estate. Sandia Realty & Property Management, LLC is now defunct |
