Himes Machinery SCAM / FRAUDULENT ADVERTISING / DECEPTIVE BUSINESS TRANSACTION Internet |
17th of Apr, 2013 by User721289 |
Dec. 6, 2012, I bought an item from Himes Machinery advertised as a 2004 model Aronson welding positioner and listed to be in great working condition for a price of $18,900. During the purchase I talked numerous times with Brian at Himes Machinery, who gave me the impression that I was buying a machine from the stock floor. When the machine arrived and was unpacked approximately 30 days later I found out it had been grossly misrepresented. The unit was damaged, in poor shape and the back elevation rack was worn out. In an attempt to order replacement parts I was told the welding positioner was actually a 1974 model, not a 2004, as advertised. I was also told replacement parts are nob longer available. The condition of the positioner was found to be less than average even for its vintage year. I immediately attempted to contact Himes Machinery, leaving several messages over a period of days which were not responded to promptly. Once I received a call back, I informed Himes Machinery I received the wrong machine. It was during this time I learned that Brian is actually a broker who had taken another’s word on the condition of the machine, he had never seen it. I was told the advertisement of a 2004 Aronson welding positioner was a typographical error and that I did in fact get the correct machine, as the 1974 model Aronson welding positioner was the intended listing. After admitting misrepresentation of the machine with their typo mistake, Himes machinery would not allow me to return it for a refund even though I did not receive the item I paid for. In an attempt to recover some of my loss, I offered to return the machine for a refund of $10,000 and take a loss of $8,900 but Himes Machinery refused this offer as well. Due to the gross misrepresentation of the machine, I feel the item should be allowed for return and my purchase price fully refunded. Since Himes Machinery refuses to do so I have no choice but to regard this transaction as misleading and dishonest.
