I wanted to add some new roses to my rose bed this year, and found that Growquest Growers had the 5 roses I needed; I ordered them March 17, 2011, and the total was $135.26. I paid with Chase 'Quick Pay', but Mr Gilcrest finally wrote back and stated he had just gotten married and was behind with everything; so behind that he didn't accept my 'Quick Pay' payment within the 10 day time frame. I wrote GrowQuest several times, attempting to get an update on the status of my order, with no results; I finally sent a cashiers check for $140, and did receive an e-mail back from Mr Gilcrest thanking me for the payment. Still, no roses. Still, no response to e-mails, and every time I called I was transferred to voice mail. How do you deal with someone like this ? I've dealt with many of the nurseries and rose companies on the internet and have never had any problems as far as communication and receipt of merchandise. I live in TX. I'm not sure if I start with the Texas AG, start with a federal agency, or what. I have e-mails from Mr Gilcrest acknowledging receipt of my check, a copy of my order with the 5 roses listed....I mean, whata' 'ya have to do with someone like this ??!!!! There's no telling how much this character makes off of people unfamiliar with his "no send" scheme. Any questions answered, and help appreciated. It's actually more about the principal of the thing now than the money. Thank you. |

I contacted the Santa Paula California Police Department and they are very aware of this guy. They sent me to the California D.A. deptartment of consumer fraud. They faxed me over some easy paperwork and I sent everything in via fax. They have been on this guy since 2009 and I do not know why he still has a website and a bank account and he's not in jail. I do not understand our justice system. He's just thumbing his nose at the legal system and they are sitting back and taking it. Good Luck

I just sent Chris Gilcrest another email about my order. He gladly cashed my check, told me my trees are on their way, but to date no trees. It has been since September that I've tried to receive satisfaction. Now I see his website is shut down. Maybe I can take some satisfaction in that he has been finally caught. |

I ordered live lady bugs and never received the bugs but they were quick to take my Inuit payment. They never answer their phone and never return voice mails. I've been contacting them for nearly 90 days now and only get vague emails back stating that they'll process my refund but nothing so far.
Their website says it prefers email orders and I can see why when you don't answer your phone. This is fraudulent.
I live in Georgia, does anyone know how I can claim fraud on this side of the country? I did do a BBB complaint just to satisfy myself so I can sleep at night knowing I was stupid to fall for this site.
Just post back how someone can file a claim against him. |

we've bought two olive trees from this guy, but luckily changed our mind and canceled with him hours before he would ship.That made him mad, and demanded money for all kinds of ridiculous things like his hours of going to fedex, hours of putting together some wooden box (he claims 3.5 hrs) to ship across country that weights apparently 120lbs (we would have to pay for shipping for all the 120lbs of wood of course to ship less than 1/2 lbs of olive trees, that he claimed he took out of the pots for shipping, that means they are bare rooted, but he insisted to ship them with a week long method.(the trees would of been dead by than)He demanded money for the pots he had to "replace" because we changed our minds, (yeah because in nurseries people just throw out pots left and right) more than twice as much that they actually cost and he still have, but he asked us to pay for it.he demanded payment for the wooden box he never shipped, and still have claimed hours of travel to fedex and asked us to pay for it meanwile it is only 17 miles away from him and he could of have shipped other items too in the same time.He threatened us to take us to the court if we don't pay him.He wanted us to pay $126.00 because we changed our mind.

28.00 to undo the box
28.00 to re pot the olive trees, since they will need new containers now
42.00 FedEx cartage (that he went to fedex)
Looks to be about $126.00 for that error in thinking on your part"
he did not shipped anything did not paid for shipping, did not lost anything, but apparently this is the easiest way to make money.When we refused to pay and gave him detailed explanation why, he got even nastier and angrier, trash talking about us, bashing us with all kinds of lowlife comments.Apparently digging after us online and bashing how crappy is our house in his opinion and that we must dress from walmart because we look like such lowclass people to him.Every email he took his threats to one step further to try to extort money, threatening to take us to court, and saying we have to pay all his paralegal fees to serve us with papers that is apparently as he say is 450 dollars (we know that it's about 30). So now he is demanding in his words:
"126.00 for the cost of the return of the goods and labor
12.00 bank charge on the check
35.00 charge on the returned check
35.00 office charge on Monday for the certified mailing to you.
Then there will be the
450.00 estimate on the cost of the paralegal in your area to file the collection in small claims or low level court".
Again, we have never received anything, he never shipped, and he still have his plants his box and his pots.But demanding money with the most forceful way he can.
We have made it very clear that he is demanding money on false basis and we will take it to higher authorities, but he doesn't seem to care enough, he still gave one more try of: "you better pay up now, or else you have to pay the court fee too" trick, to try to scare us into paying.He seem to be very desperate.
Ps to anybody who he lured into buying something from him: cardboard boxes are used to ship 6 ft tall fruit trees are 6dollars, and even if the tree comes with heavy pot full with dirt cost about 60 dollars for a two day shipping.Not hundreds of dollars in a crappy 120lbs wooden box.If they shipped bareroot should be even cheaper.I've read from other peoples comments this scammer have multiple websites, I guess because he have a really bad reputation.be very careful.Also do not accept payplal.very likely because he scammed so many people he was thrown out. Nastiest seller, and the fact that he was trying to scare us and threaten us into paying him money for false fabricated basis deserves police or higher authority attention in my opinion. |
