Golba Group Harassment, Violation of Landlord/Tenant Laws, Physical Threats Gilbert, Arizona |

I am writing to you due to a series of events that transpired this week with Golba Group/Century 21 office located at 1044 North Gilbert Rd. #1 Gilbert, AZ 85234 (I notice they advertise an address that is not accurate per their licensing as indicated on their website). They are a property management firm based in the SE Valley. I can hardly think this is anything close to the only complaint against this organization, but I present to you evidence both in writing and on video. 1) I was served with a notice on Monday to inspect property that was to take place on 04/28/2011 between the hours of 10am and 3pm. 2) I contacted Carrie DeRaps at Golba Group/Century 21 via email and advised her this date is a conflict due to an already scheduled carpet cleaning at 10am. I have these emails to serve as evidence. 3) I offered numerous solutions of which none where good enough. This is not an abnormal response from Golba Group/Century 21 as we have had these issues in the past with this group. 4) I was forced to cancel the carpet cleaners due to their refusal to cooperate and work within an appropriate schedule. 5) I advised Golba Group/Century 21 via email this morning (as I have done in previous inspections) that there are no pictures that will be taken within the property, to include inside and out. It was clearly stated that the only pictures they would be allowed to take would be from the curb of the front of the property as is all that is allowable by law without consent. 6) Golba Group/Century 21 showed up at the property at 2:54pm (only allowing 6 minutes) to begin their inspection. A gentleman that I do not know the name of and Carrie DeRaps were present. 7) I noticed a camera in the mans hand and immediately advised him there are no cameras allowed in the home. He refused to take the camera back outside and indicated he would not take pictures anywhere on the property. 8) Carrie DeRaps even went as far as saying she is going to take a picture of an outside tree in the backyard even though it was to her directly that I sent the email advising her the only place pictures will take place is from the front curb. I advised her the only person taking pictures anywhere else will be me. 9) This man ran through the house in a way that I could not be present with him and Carrie DeRaps. 10) Due to suspicions of him taking pictures upstairs, I went up and when asked if he is taking pictures, he shrugged off the question and redirected. He was obviously taking pictures upstairs. 11) They then proceeded outside. 12) They were outside alone for a short period. 13) When I went outside, I was redirected by Carrie in what was a deliberate move on her part to distract me from the other gentleman in their devious attempt to do EXACTLY what I have advised them they will not do, and to take pictures on the property that I hold lawful possession of. 14) At one point, I turned and he was blatantly taking pictures as I advised him would not be done on the property. He knew of these improper actions as he was trying to stay hidden around a wall while doing it. 15) I immediately told him pictures are NOT to be taken. 16) He advised me he is outside and to relax. 17) I AGAIN told him no pictures, as he blatantly refused to listen and kept taking as many pictures as he wanted. 18) I approached him with the intent to stop this activity and tempers rose. 19) Upon my approach he re-approached me in an aggressive manner and stood in my face nose-to-nose. This person was on my property, with MY children present, doing EXACTLY what we told them not to do. 20) My wife witnessed the entire event from the window and immediately came outside. 21) By this point (3:00pm on the nose, I have video logged evidence of this) I told them to leave the property. He refused. He told me it wasnt my property. I reminded him of what a leasehold agreement was and he proceeded to tell me yeah, youre the big bad real estate guy in an attempt to escalate the events. I remind you that this was MY home, with MY children watching this person do this. 22) It was not my intent to stop an inspection even though their allotted time had expired, but at this stage, this man was no longer allowed on the property based on his actions and threats. 23) I proceeded back towards the home as the followed immediately behind me in an obvious aggressive nature. 24) When I stopped and turned around, he again got directly in my face in a hostile manner. 25) I was almost left with NO CHOICE but to use physical force as he at this stage has refused to leave on at least THREE requests to do so. 26) He indicated he was trying to leave. (apparently through me was the only way he could go?) 27) I directed him to the side gate as there was no way this person was coming back into MY home, with MY children present. He advised me Im an a**hole on his way out. 28) Carrie at this stage hung around as if she was a welcome guest. 29) She indicated she is not leaving and will wait for the police. 30) I told her she will do it out front and not on the property. Carrie took it upon herself to open my doors to my children of where she has already been involved in a hostile encounter that she has caused. I nearly used force on her but instead stuck very close to her. 31) My 5 year old son was noticeably shaken by these events. 32) The Police arrived roughly 10 minutes later. They took both stories. 33) I advised the Police Officer while they were standing by Carrie that they could conclude their inspection should all cameras be left outside the property as I previously requested both in writing and in person (on video and email). 34) At one stage, Carrie was trying to tell the police she wants the dog removed from the property that we have a legal right to have as she is on the lease. She was obviously angry and trying to do anything to make herself feel better, including violating our rights under the lease. 35) The Police asked them to leave the premises as they refused to earlier. CONCLUSION: 1) There is no doubt that the actions of Golba Group/Century 21 where intentional actions to cause commotion and they purposefully and deviously misdirected me in a very practiced and professional way to get what it is they were strictly forbidden to do. 2) They have violated my right to the free and enjoyable use of this property. 3) They have violated my right to privacy. 4) They have taken pictures of my belongs and those of my children unlawfully. 5) They have violated my person rights unlawfully by refusing to leave when asked and directly in front of my children. 6) They have caused for my 5 year old son to have fear within his own home asking me if people are allowed to come in to our home to do this. Do they have no common sense at all?????!!!!!!! They did this in front of a child??? ADDITIONAL EVIDENCE: 1) I have all emails stored that I speak of. 2) I recorded the entire event on video recorder that transpired at the house as complete evidence of my claims. a. I would like to know who I can present these too for IMMEDIATE ACTION 3) I have documented emails of many instances of bullying and abuse by this organization. With the skill and precision that they attempted to pull this distraction off, I have to wonder how many times this was practiced on previous tenants who know less on how to defend themselves on these actions. I will be filing an Injunction Against Harassment, towards this organization tomorrow. I expect something will be done to Golba Group/Century 21 complete and lack of respect towards my rights and the rights of my family that was forced to watch and hear these ridiculous actions. I thoroughly expect a retaliation from Golba Group/Century 21 tomorrow and the coming days to spite and harass me and my family. Im sure their first claim will be that we did not allow this inspection. As mentioned, I have their notice and I have video recordings that will show they were asked to leave after their 3pm deadline was up, not that I would not have asked them to leave anyway based on their actions. These actions are despicable and repulsive. Action needs to be taken against them to immediately stop this harassment and allow for reconciliation of the damage they have already done. (There are reasons our home is not allowed to be taken photos of. Reasons that Golba Group/Century 21 and their actions have now caused concern and feelings of uncertainty. Reasons that Golba Group/Century 21 has limited knowledge of, nor should they. Yet they have their own malicious intent at heart.) Evidence these pictures were destroyed and verification and evidence they were NOT distributed and shared with ANYBODY is an immediate need. Reconciliation is next, and Golba Group/Century 21 being released from management of this property is third.

No offense, but it can't be a coincidence you were cleaning the carpets JUST before these people arrived, that you want (keyword: WANT) "no pictures tobe taken within the property". "I advised him [the inspector] there are no cameras allowed in the home". What, are cameras against your religion? It sounds like you trashed the house, gave them numerous red flags that you were a nuisance, and acted like a plumb turkey to avoid charges.
Folks, your landlord can and will enter your home for repairs, inspections, etc., as long as you got 48 hours notice. Stop deluding yourself with ideas you have "lawful possession" of anything -- it belongs to the owner and landlord.
My favorite line: "He advised me I'm an a**hole on his way out." ...Good advice you should take to heart. |
