Gary's pool and Patio fraud-promised a year and a haft old in new like condition pool--got a10 plus yr. old with a three ft. crack and a one ft crack |

I purchased a reclaimed pool from Gary's pool 2-19-13, but was not able to inspect the pool for it was still in the ground in S.A. according to Gary's salesman Jonathan Tutt. We put the money down and signed the contract. It called for the large payment when the pool arrived at our home. Jonathan Tutt told us the pool was only year and a half years old and in like new condition, that the prior owners wanted a larger pool, so they had this pool pulled out. The pool arrived at our home on 4-19-13. I had gone to the store in Orange Grove when it arrived. We have a lot of space around our home ,at first Gary parked the pool around the corner where you could barely see it. He sent Mike McCaine to the door to collect the check. My wife was on a long distance call when he knocked on the door. It was a very important call about her uncles sickness. She looked out the door but could only see the front of the pool, so she gave him the check. I got home a couple of minutes later, Gary saw me walk up to my home. I talked to my wife and found out she had paid him so I went out side to look at the pool. In that two minutes Gary had managed to unload a 29 by 13 foot pool and got off my property and drove away. I looked at the pool and called a halt to any more work, the pool he brought to my home was 10 plus years old, it has a 3 foot crack down the inside on one side and a foot crack on the other, Gary's sometime in the past in order to try to fix the 3 foot crack had put fiber glass around the top of the pool then rolled on resin over the rest of the pool, bad job is very large understatement. The old gel coat is showing thru on all sides, I thought it was dirty, there are resin runs and drops on all sides also. Gary'y sent out a fiber glass expert to fix the problems, this man refused to do the job for the quoted amount because Gary had not been honest with him about the pools condition. He told Gary's that it would cost between 2500. and 3000. dollars to make it useable. He told them that if he buffed it out (Gary's idea to fix it) the gel coat would show thru even more and he could never get it smooth with what Gary wanted. Gary'y deceived us so we would sign their contract and it has been one deception after another from beginning to now. |
