Extended Stay America Discrimination, breach of contract, unauthorized rate changed Dayton, Ohio |

My home burnt down on December 2, 2011 and as a result we were left without a place to stay so the Red Cross put us in one motel for 3 days and then our insurance company prepaid for one month stay at the Extended Stay America. We were quoted a rate of $39.99 a night plus 13% tax until the 31st day we stayed because we would become tax exempt and the taxes collected would be refunded. The 1st three nights, they forced us to stay in 2 different rooms because they did not have a larger one room available but they SAID they would only charge us for one room. Instead they double charge us for the 1st 3 nights we were in 2 rooms. We have already paid $1,550.00 in advance and now after 16 days they are asking us to leave because somehow, without having ever asked me, they found that I had a felony criminal record from 10 years ago and all the sudden this is against policy but they cannot show me a policy at all let alone one that has restrictions on the types of people who can and cannot stay in their hotel. They want us to leave but refuse to refund our money now so that we can go somewhere else. They want us to wait. They wouldn't have given me a room and then waiting on payment, they want their payment up front so why can't I get my refund when you tell me I have to leave? In addition, the refund they want to eventually give me is FAR from what it should be. They want to give me $480. We stayed a total of 17 days and at $39.99 a night that is $679.83 plus a $150 pet deposit is $829.83 with tax the total is $937.71 so my refund should be a minimum of $612.29 but they refuse this and will not even show me how they came to their figure. HOWEVER, I believe that since we had every intention of staying here for 4-6 months while they rebuild our house and obtaining that tax exempt status they should have to refund all my taxes paid since they decided they were kicking us out for something I did when I was in High School. So they should have to refund a total of $720.17. The rooms are disgusting because they only clean once a week, if that and they do not clean everything. The microwave had mold and slime on the shelf under is and dirt and slime on every surface but the front where they could easily wipe down. There is dust all over everything. The staff is fake, the smile at your face and talk behind your back. For example, they pass judgement on me for my criminal past when they know nothing about it or me. The give my wife dirty looks then when confronted about it are too much of a coward to admit it. This business should just do everyone a favor and close their doors. Tomorrow morning, I plan on contacting the local health department so they can come over and look at they filth that is in these rooms. Every since we had to move in here, everyone in my family is having sinus problems and getting sick so it would not surprise me if there is mold in the rooms. I truly hope the health department closes there doors until they at least clean this place up. I cant wait until tomorrow when I get to contact my attorney and file a lawsuit for discrimination again the company and its staff. They think they can do whatever they want and people will just lay back and take it and maybe for the most part this is the case but I plan on making there lives miserable for as long as I am able. |
