11/06/06 returned to California to meet with Larry in Rancho Cucamonga on 11/07/06 upon my arrival I checked in with Larry and he said closing would happen on 11/08/06. We scheduled another meeting for 11/09/06 they were not ready until the then. I showed up at 8:00am in Rancho Cucamonga, CA entered the office and was told they were not ready to hang out and I was placed into a conference room with a bottle of water. It was hours that passed around 1:00pm I went for lunch. There was so much going on inside the office about my loan I felt as if I was in the way. I returned at 2:00pm and waited another 3 hours. At 5:00 pm the loan was ready to close. (The builder was scheduled to leave the office at 6:00pm) and a notary showed up and paper work was being signed. I spent the Whole day with these people ( 9 Hours)and was so glad to get out of there and realized I had nothing in my hands to show the builder for the release of the keys so I called Larry XXXX from my cell phone and he called the builder to confirm funding. I then had to call my Sister and coordinate with the builder to release the keys to my Sister who lived in XXXXX. The builder agreed. In the meantime I had no idea it would be so backed up on the Freeway I would not make it to the builder on time.
11/14/06 while I painted the home ( I thought was funded) thru the weekend this day the doorbell rang and Tom and Marilyn ( the builders) told me I had not been funded. They would give me thru the rest of this day to resolve this problem or I had to leave the premises until the new home was funded. I called Larry XXXX and he said he would check into this. Finally after hours of waiting he called and confirmed you are funded This satisfied the builders and I remained in the home.
11/27/2006 I flew back to XXXXXXXXX to pack
12/14/2006 I started to drive to California along with four 35 foot Penske moving trucks and my animals.
12/17/2006 I finally arrived.
January 12, 2007 I was told by Finance Company loan officer, the Economy was about to blow and no one was taking refi's it was going to get Ugly out there.
January 15th 2007 value of the property was now $350,000.00
February 2007 I started to fall behind in the note and was contacted by Wells Fargo.
October 2007 I attempted to file Chapter 13 to protect the home. And throw the forbearance into a payment plan I Spent 4,800.00 with attorney Cynthia Dunning in Colton ,Ca
E.M.C. took over the Loan
February 25th,2008 sent $3,500.00 good faith payment to E.M.C. for a forbearance agreement via Western Union Isabelle was witness to this.( she is a Real Estate Agent) January 1st, 2009 I bought the business from Mr. XXXXX
May, 2009 filed for Bankruptcy protection.( Law Firm)$ 2,500.00 and to eliminate the Second Mortgage of $ 84,00.00
06/10/2009 requested lowering of escrow taxes because the home dropped value to 262,000
06/15/2009 letter of receipt to lower escrow was confirmed by E.M.C
(Nothing to date was done to lower the tax escrow)
September 22, 2009 I was offered the Obama Plan By Jeff at EMC Trail Payments for the Modification started Dec 1st 2009, January 1st 2010 and I was told I could not include my Husbands income it was not recognized
(Same sex Marriage) by E.M.C.
March 1st 2010 I heard nothing from EMC about the Modification and I called concerned it would not be ready for the next monthly due date I would spend hours waiting only to be hung up on or sent to a different department by mistake. until a denial letter dated July 16th,2010 this was for H.A.M.P
October 22nd, 2009 Lift of Stay was granted to E.M.C
August 3rd, 2010 10:25am, contacted Nicole at Chase Bank about a repayment plan she advised me to call E.M.C since she was unable to pull records from her office. (Chase Bank now owns E.M.C.)
August 27th, 2010 Notice of Transfer to Marix Servicing
September 30th,2010 received a letter from Marix Serving accepting my request for a modification
October, 2010 Value of home is now 239,300.00
October 13, 2010- Default in Mortgage was filed
October 22nd- received a Modification from Marix and I would not sign it because of a balloon payment of 56,000.00
October 25th 2010 called HUD and created a Budget to present to Marix Servicing. November 8th 2010 spoke to My attorney and she suggested to fall out of Chapter 13 for now and to re-file a Chapter 7, when needed
November 13th, 2010 Hired Michael to represent me.
