My husband and I purchased 2 units in the late 90's from Embassy Suites. These are both deeded property. We go to Maui at least once a year. In 2009 while we there we always go get a update on our property. We got talked into owning yet one more unit. It had changed from Embassy to Sunterra now to Diamond Resorts. We loved our visits and we owned our property. But the new way was points. Because we owned to properties we would be a Gold customer. So again we purchased a unit the Hawaii Collection but it was the point system because they said it was better. Luckily we were smart enough not to give up our 2 deeded properties. Like everyone else we were surprised to find out we now owe $3600 for our maintenance fee due in January 2012 for a time share we have only used once. Plus the maintenance fee for the 2 deeded properties.They did not disclose the fact they new the Point of Poipu timeshare had water damage when we signed on the dotted line and paid cash for it. We too called but they were rude and said we had no choice but to pay or they would foreclose on us. But how can they do that when we own the property. We checked our paperwork and found in small print we bought as is. So we went to visit Las Vegas and stayed in a time share there. We were told numerous times by Diamond Resorts Employees we were smart not to give up on our 2 deeded properties all we needed to do was convert the Hawaii Collection into the US collection for only additional $10,000 which is the cost of the new maintenance fee over the next 5 years. We told them no thank you and we are now walking away from the Hawaii Collection, getting out of the club, and going back to directly using our deeded timeshare directly with Kaanapolli Beach Club. We tried selling it but no ones wants a property that is damaged. We tried giving it away but again who wants to pay $3600 over the next 5 years when you can go to Hawaii and stay in a hotel for half the price every year. We would love to be a part of a Class Action Suite against Diamond Resorts International. They have defrauded us and everyone else that bought into their sceem and will probably get away with it unless we can fight back. We will be getting a letter soon from them because we are not paying those dues. Lets fight back. |

We have seen huge increases in management and maintenance fees all of which have been approved by a board of directors controlled by DRI. At the same time, we have observed resort maintenance go into decline. Because of the poor economy, coupled with large increases in maintenance fees, some owners have gone into foreclosure. Most of those foreclosures have been purchased by DRI to convert into their vacation club point system to sell for a large profit. DRI, themselves, calls this a strategy for profitablility, “Capital Light”. In my opinion, it is predatory and offers the consumer a single remedy, pay more to Diamond Resorts.
During October of this year, deeded owners and Diamond Vacation Club members received bills that have burdened them with huge assessments to repair a water intrusion problem that Diamond Resorts has known about for years, but has done nothing to correct. Each deeded owner is being billed $5, 893.32 for each timeshare week owned. This is in addition to the normal annual maintenance fee of $1, 259.28. In our opinion, these assessments are designed to force many owners into foreclosure in spite of threats from the board to collect outstanding assessments by legal action or a collection agency. The special assessment fee is $65.8 Mil for water intrusion that the owner’s knew nothing about until DRI sent a letter out in late October, with the monies due January 1st.
In our opinion, without access to the owners list, deeded owners, who are not DRI employees or relatives of DRI employees, will have little or no chance of being elected to a board position. Furthermore, as long as DRI refuses to release the owners list, they will continue to control the board and to vote in and fill board positions with DRI employees or individuals with a potential for biased decisions in favor of DRI. |

Now DRI is demanding that us Owners pay $65M for ‘water intrusion’ problems at our resort. If not, they will foreclose on us. Factor in that 4 of our 6 Board Members are DRI employees it is easy to understand why DRI is able to take such advantage of us Owners. Our $20K investments (deeds) are now selling for $1 to $100 on Ebay. Run as fast as you can from this DRI corporation before you too become a victim of dishonesty, a dictatorship, and outrageous management fees.
