Cooper Sterling Auction Services Jim Mirkamani Cooper Sterling Auction Services sold me a fake Omega watch as an authentic one. toronto, Ontario
23rd of Sep, 2011 by User317032
At the auction sale at the Delta Airport Hotel in Richmond,BC ,Cooper Sterling Services sold me a fake Omega Seamaster watch as an authentic for $2,464.00. The watch did not keep the correct time and was completely stop working every night at approximately 3:00 am. I brought the watch to Rodeo jewellers to find out what was the problem. They could not fix the problem themselves and sent the watch to Omega in Toronto. Omega in Toronto after receiving the watch replied that the bezel on the watch is not manufactured by Omega and ,therefore, would not repair the watch. I calledMr.Jim Markalani in Toronto on September 21,2011who sold me the watch to me at the auction sale in Richmond,BC advising him of the situation with the watch. He asked me to send him the Omega letter stating that the bezel is not authentic. I immediately send him the letter via fax, Rodeo Jewellers also send him the same letter from Omega in Toronto.
The next day I called Jim again and request the refund for the watch he sold me since the watch was not an authentic watch as represented and the certificate of authenticity states. He promised to refund the money. I send him several e-mails confirming our telephone conversations and his promise to refund the money. Nothing was done by Jim as promissed. Quit on the contrary,he was not answering any of the phones advertised on his business card. He basically disappeared into the thin air. I sent him several e-mails and received no replies at all. I have contacted the City of Toronto. The City of Richmond and the Delta Airport Hotel and got nowhere with any of the institutions and the Delta Hotel. I was advised by both City of Toronto and the City of Richmond that Cooper Sterling Auction Services is not registered with any of these cities and therefore does not have a licence to conduct an auction business. I would appreciate any help you can extend to me. I am seriously thinking to pursue it through RCMP in Toronto and Richmond,BC. Sincerely, Roman P

This is just so incredibly amazing;

ROMAN PORTNOY president and General Manager of AVION-MULTIPLEX CONSTRUCTION INC. 604-207-9967 did purchase an Omega watch from one of our auction sales.
The watch had a reserve price of $1, 700.00 (that was the agreed reserve price with the consignor of the watch). It ended up selling to Roman for $1, 900.00 (that was the last bid and it was Roman’s bid). The auction house charges 15% commission to the buyer ($285.00) and 10% commission to the seller ($190.00).

All together Cooper Sterling Auctions made $475.00 out of this transaction with Roman.

Every watch is sold with ONE YEAR LIMITED WARRANTY, it is offered by the consignors and we simply pass it on to the buyer.

Roman did call us about problems with the watch keeping accurate timing, he was advised to either ship the watch via fed-x, insured by us off course, to our Toronto office (for faster service) or hang on to the watch for a couple of weeks longer until someone from our office would be in Vancouver and collect the watch from him and bring back to Toronto for service.

Without getting into any details as to how little manners Roman has, he argued that he WISHES to have the watch serviced in VANCOUVER by an AUTHORIZED OMEGA DEALER of his choice and that Cooper Sterling Auctions would have to pay the cost of the service.

Although this was never part of the sale agreement, I did agree so, that ROMAN would be satisfied.

Later he advised that the watch has been looked at by REDOE JEWELLERS in VANCOUVER and the estimated cost of service would be $650.00 plus HST.

Once again, keeping in mind Cooper Sterling Auctions had made only $475.00 from the sale of this Omega watch and, by agreeing to ROMAN’S demands Cooper Sterling Auctions would actually loose $253.00 as the result of this transaction, I agreed.

Well, after all that, almost 6 months later he is now claiming that the Bezel on the watch is not manufactured by Omega! and he is demanding to be refunded! this obviously generates a whole set of questions but, I did agree without any questions however, he would have to refund Cooper Sterling Auctions the $650.00 plus HST that was paid to ROMAN PORTNOY in lieu of the watch having supposedly been serviced by Redeo Jewellers.

This; ROMAN did not like, first he filed a complaint with BBB, that didn’t get anywhere then, he commenced an action in the small claims court in Richmond however, forgot to serve Cooper Sterling Auction with the claim and the smart guy he is; did manage to get default judgment which is being dealt with and, now this post here!

Following posts are some of the email communications with Mr. ROMAN PORTNOY.

Hi Jim,

Further to our telephone conversation of today, I would like to reiterate what I was advised this morning by Dave from Rodeo jewelers in Oakridge Centre, Vancouver, BC .Their phone number is 604.266.6339.
Dave advised me that the Omega watch I bought from your auction in April, 2011 has the following problems:

1.The watch in questions has never been serviced and if it was in the distance past was not done properly.
2. There is a gap between the crown and the case, therefore, there is no seal. There is also a scratch at the back of the watch made by somebody who tried to open up the watch.

In order to fix it the following must done:

a. Complete overhaul of the watch
b. Replacement of the crown steam and the tube since they come as a set.

The appraised and quoted cost for the repair is $ 650 +HST.

As per our agreement of today, please confirm by return e-mail that your company Cooper Sterling Auctions will pay the cost of the repair as per the above items a and b.

Sincerely,
Roman Portnoy, P.Eng.

I actually went to an auction on January 1st 2013 in Montreal from this company, bid and won a Panerai PAM352 a real great price. Took it to a watchmaker and he confirmed that it was authentic and was working perfectly. I initially purchased this watch to sell and to make a few dollars, but the watch and the deal was s great that I decided to keep it. I met Jim at the auction prior to the bidding and he took out as many items I wanted to see and took time with me to answer all of my questions. I've been a watch collector for many years, I can honestly say that Jim was really helpful and professional. I'm sorry to hear that someone had a bad experience with this company, but I personally will try to attend all of the auction that they will have in my city.
