This company masquerades as though a pseudo-governmental organisation, but aren't. They lie to extort a fee to provide a worse service to those seeking to obtain a CSCS card, by lying and telling them that this is the cheapest that it can be done. They then say that the books and CDs cost 3 times as much as they do. On top they provide wrong info., even including booking tests in venues which are very much further away than actually necessary. They threaten to penalize those who complain, with fines.

Thank you for accepting receipt of this email from an email which you "don't check" (more lies), and consenting to with prejudice standards of discourse. Either you make the payment by the end of the day tomorrow, or CC proceedings are going to be happening on Thursday, in the morning.
You clearly don't know what you're doing, as you have already had the opportunity to state your terms of business, prior to taking the money. What you have written, is deceptive (the tort of deceit), in that you make untrue, and illegal representations; but none the less, you would still have no option to dictate a fee schedule, for the stated reason. It is you who have created the problem, based on a wrong which you have wilfully orchestrated, which lead to the harm, with consequential unjust enrichment, which is why you can't expect me or anyone else, to suffer further as a result. Clearly to charge someone for you to explain yourself is preposterous, even if the other reasons weren’t sufficient to negate such an idea, so you make a fool of yourself.
I didn't get the whole of first part, but it clearly demonstrates that you don't know what you're doing, so maybe to show your cards was unwise, and you shouldn’t have said anything. You see, hypothetically speaking, we are either in contract, and you are in breach, or, we aren’t in contract, as a contract entered into following fraud is void in ab initio, but I doubt you were aware of your statements supporting that (if that were so, it would appear that you are trying to charge based on a boast of criminality).
Now that it has been established that you do actually receive these emails, I hereby make a Subject Access Request (SAR), in accordance with the Data Protection Act 1998, for the two of only tow phone calls (one inbound, and one outbound), with their illegal (including Fraud by Misrepresentation, Fraud Act 2006).
I demand the phone call records of all of the calls, including any notes on these, and any internal or external communicaitons relating to the money or the apparent service, or its subject matter. You have 28 days to comply, but the court action needs to dally no longer, as you have made your steadfast unreasonableness clear, and ignorance only knows the stick. This in no way effects the peripheral activities, which are morally unavoidable, or, the costs which you I am afraid shall bear. Failure to agree to this demand shall spark a complaint to the Data Commissioner, which shall also be chargeable. This has taken an hour to write, if we take into account, checking, emailing, and the trip to the Post Office, so the Fee Schedule stands at £100.
Do yourself a favour, and pay that money back immediately. This does not affect the demand for the phone calls as per the SAR.

I herby notify you of my instruction to cancel the card payment which was made yesterday, on behalf of Alex Bota, from my card. Please confirm your having done this as soon as possible. Should you not respond accordingly in conformation, by this time tomorrow, with verification of transfer of funds, I shall be forced to contact my:
1. bank, to cancel the payment, and report a fraudulent transaction;
2. Trading Standards as you are masquerading as the government, and are making illegal representations, regarding there being no recourse to cancel transactions, despite this being at odds with the Distance Selling Regulations;
3. the Police (re. Obtaining a Money Transfer by Deception); and,
4. yourselves, to obtain a Subject Access Request in line with the Data Protection Act, to obtain the calls, which detail the catalogue of abuses. Should you decide that you “may” have not recorded any of these, then the means by which this selection is determined shall be sought, and shown as a further instrument of fraud.
All of which will take time, which shall be chargeable, at my rate, which I hereby state as £100 per hour. This misappropriated transfer, as well as miscellaneous associated costs, shall be pursued through the small claims court, on the same basis, and all of that which is found shall be published widely. I anticipate the costs associated with this, are likely to run into a substantial sum; probably upwards of £1,000, especially should a court appearance be necessary, with the necessary research, etc..

Test Procedure
If any of the details on Your confirmation letter or email are incorrect You must contact the Customer Service Team on 020 31373432 immediately.
Tutorial
It is essential You are familiar with how the Test is conducted. After the Test Centre staff have explained the operation to You, You will have the option to conduct a tutorial to see how the test will work and look on screen, so You are familiar with the functionality before You sit Your Test. The tutorial is not a practice test, and we strongly recommend You take advantage of this 15 minute tutorial, as once the Test has started, it is not possible to interrupt it.
Conduct
You will not be allowed to bring anybody in to the Test room with You. Any items You are carrying (including personal items such as keys, phones, bags, watches and wallets) must be stored in a personal locker provided at the Test Centre. Please note You must not refer to any document during the Test. All Test Centres have CCTV and all Tests are recorded for security and detection or investigation of fraud purposes. CCTV footage is retained securely by the test provider for a period of up to two years. Any misconduct [by You] during the Test will result in Your Test being stopped, Your Test result void and Your Test Fee being forfeit. Candidates guilty of serious misconduct, including cheating, may forfeit their right to take a further Test. In addition CITB-ConstructionSkills reserves the right to revoke a Test pass if it reasonably suspects that You have been involved in or are linked to any misconduct, fraud or cheating.
The Test Centre staff will explain how You can attract their attention if You should experience any technical difficulties during Your Test.
If You are unhappy with the way in which Your Test has been conducted You should bring the matter to the attention of the Invigilator or Test Centre Manager.
If You are unable to resolve the matter at the Test Centre, You should write to the Customer Service Team, CITB-ConstructionSkills, c/o Pearson VUE, PO Box 381, Manchester, M50 3UW. You must do this within 15 working days of sitting Your test.
If, after receiving a response from the Customer Service Team, You are still not satisfied, You can write to the Product Manager, Health, Safety and Environment Testing Team, CITB-ConstructionSkills, Bircham Newton, Kings Lynn, Norfolk, PE31 6RH.
Reschedule PolicyIf You wish to reschedule Your test You must do this at least 4 working days before Your scheduled test date and time. You will be unable to reschedule within 72 hours Your scheduled test date.
There will be no charge for rescheduling outside of the 72 hour penalty period.
Cancellation PolicyYour Right to Cancel.
If You cancel Your test without giving 72 hours’ notice, no refund is payable.
A refund will be paid for cancellations outside of the 72 hour notice period made via our telephone booking line, but will incur a £10 administration fee.
A full refund will be paid for cancellations outside of the 72 hour notice period made via our online booking system, with no administration fee charged.
Refunds will be made by credit/debit card refund or by cheque and will be made within 15 days of receipt of valid request. No refund will be given if You paid for a test using a voucher, but You can reschedule as per the reschedule policy.
CITB-ConstructionSkills right to cancel.
CITB-ConstructionSkills reserves the right to cancel (including cancellation on the day of the Test) if the Test Centre experiences a problem outside their control (including but not limited to electricity failure, security alert) and in such circumstances You will be offered an alternative Test date.
In addition, CITB-ConstructionSkills may terminate this Contract (without liability to You) if You are in material breach of any of any of these Conditions.
Additional Information
Special Assistance
All special assistance such as readers, interpreters and signers must be arranged in advance
If You have difficulty in reading, all testing stations have headphones which will allow You to hear a voiceover of the Test in English or Welsh. Please notify the Test Centre staff on arrival that You need to use these. The Test Centre staff will explain to You how the Test will be conducted.
If You have requested a reader, interpreter or signer, or other special assistance, it will be shown in the ‘Accommodations’ section on Your confirmation letter or email. If You need special assistance and it is not shown please contact 020 31373432. If we have arranged special assistance for You and You do not take the Test on the date arranged, CITB-ConstructionSkills reserves the right to charge You the cost of such special assistance. You will not be allowed to sit a Test until You have paid such charges.
Interpretation
In these Conditions the following words have the following meanings:
"CITB-ConstructionSkills" means the Construction Industry Training Board (Registered Charity number 264289) Bircham Newton King's Lynn Norfolk.
"Test" means any variant of the CITB-ConstructionSkills Health, Safety and Environment Test
"You, Your" means the person(s), firm or company who books the Test with CITB ConstructionSkills, or where the context so requires the individual taking the Test.
In these Conditions reference to any statute or statutory provision shall, unless the context otherwise requires be construed as a reference to a statute or statutory provision as from time to time amended, considered, modified, extended, re-enacted or replaced.
In these Conditions references to masculine include the feminine and the neuter and to the singular include the plural and vice versa as the context admits or requires.
In these Conditions the headings will not affect the construction.
Contract Formation
The contract will be between You and CITB-ConstructionSkills on these Conditions to the exclusion of all other terms and conditions and all previous oral or written representations.
An application to book a Test shall be made by You, this shall be deemed to be an offer by You to purchase the Test upon these Conditions. The contract is formed when the order is accepted by CITB ConstructionSkills by way of a written confirmation [(whether by letter or email)]. No contract will come into existence until a written confirmation is issued by CITB-ConstructionSkills.
Revision Materials
Revision material is available to purchase in book and electronic formats for all test types from www.constructionaidline.co.uk or alternatively call 020 31373432.
Test Results
All candidates will be given written confirmation of whether they have passed or failed the Test. Confirmation letters regardless of test result will also indicate areas of weakness where all questions in that subject were not answered correctly.
Your test fee is not refundable if You do not arrive at the Test Centre for Your scheduled appointment. If You fail You will not be allowed to re-sit the Test within 3 working days.
If You require a duplicate pass certificate You should be aware that duplicate pass certificates will incur a £10 administration charge.
CITB-ConstructionSkills is unable to amend the result of a Test whatever the circumstances. However, CITB ConstructionSkills can order a re-test if it is satisfied the Test was not conducted correctly.
General
CITB-ConstructionSkills shall not be liable to You if it is prevented from fulfilling its obligations under these Conditions by some reason beyond its reasonable control (including without limitation acts of god, fires, hostilities, and acts of terrorism).
CITB-ConstructionSkills shall not be liable (whether in contract, tort (including negligence and breach of statutory duty) statute or otherwise) for any loss or damage to persons or property caused by participation in, or failure to pass the Test. This does not prevent or limit liability in respect of personal injury or death caused by CITB-ConstructionSkills negligence.
CITB-ConstructionSkills uses the personal data You provide for various purposes including the provision of the Test and other services.
These Conditions supersede any previous agreement between the parties and represents the entire agreement between the parties.
These Conditions shall not be deemed to create a partnership between the parties or to create the relationship of agent and principal.
You shall not be entitled to assign all or part of Your rights or obligations under these Conditions without the prior written consent of CITB-ConstructionSkills.
These Conditions shall be governed by the laws of England and Wales and the parties submit to the jurisdiction of the Courts of England and Wales.
CITB-ConstructionSkills will not be held responsible for expenses incurred beyond the cost of the test, including but not limited to travel expense and lost wages on the day of the test.
