My story started in September of 2010 when I had just finished dropping off gifts to senior citizens at our local nursing home. I had been working on the project a couple of months and was soooo happy I completed the giving of gift items to the seniors. That afternoon, I was driving home and decided to get a large coke at McDonald's since they have a $1.00 coke on there menu and it is the large one in the summer time. I turned into my McDonald's and they were doing construction remolding on the side of the building. I did not see a problem with it and continued to the drive thru. The construction was 10ft from the drive thru and my window was down as it was cooler outside and I wanted fresh air. I was waiting in the drive thru and all of a sudden this construction employee starts beating on this big piece of board he had just dislodged from the building and alot of debris, dust, possible asbestos, whatever it was, and it was 10 ft from my open window in the car. I did'nt think fast enough to roll my window up and this debris came in my car window and it set me off coughing and coughing and coughing to where I could not even place my order at the speaker but had to drive up and place my order choking to get my breath out. It was horrible. Oh it was bad. I got the coke and drove home and the coughing continued and continued and became so severe I could hardly breath. I went to the emergency room and was treated with steroids and it helped me but I coughed for a solid month. It was horrible. I could have died that night had I not gone to the emergency room, I have sleep apnea a serious dis-order. The extreme coughing, the discomfort was so bad. It was bad and it lasted all month. It was sad. I was so sick. I wanted to go back to the nursing home where I was doing my giving and had mentioned to the activity director there that I would like to give some more in the next couple of weeks but I was not able to do so, I was to ill to gain the funds to purchase the additonal gifts.
Jeremy Micco the claims agent with CNA insurance the insurer of McDonald's and the Construction company involved, denied the claim and said he would not reimburse me my lost time from earning for the seniors and or my medicals at the emergency room because my medicare paid for it and I had no out of pocket expenses. I was so sad and heart broken. I was so sad because I was down a month and sick and the pain and suffering was horrible. Jeremy however said he would not pay me because my medicare paid the emergency room and he would not pay for my pain and suffering or the time I missed helping the seniors, which was a month.
It saddens me because I know the pain and suffering I went through, I know that it was bad and that if I had not gone to the emergency room I could have died that night with sleep apnea and the severe bronchitis this caused and inflammation of my lungs. Its sad that CNA claims agent Jeremy felt I did not deserve anything because medicare paid my medicals and did not compensate me for my pain and suffering are lost time. It saddens me people can be this way. It just saddens me.
He felt like since the federal government paid my emergency room visit through medicare and I had no deductable, he should not have to pay.
I am very saddened at CNA insurance and Jeremy Micco. The claim was a legitimate claim. I had no idea I was driving into a remodeling construction site at McDonalds Restuarant and would inhale debris from construction. I simply went in to get there $1.00 drink speacial. I had no idea of the month of sickness and respiratory distress this would cause me. I had no idea. I had no idea that I would be treated the way I was by Jeremy Micco and CNA either. Really it's sad. Its very sad that infact I was treated this way. When he said no he was not paying me anything I was so upset that I cried. I just could not believe a reputable company like CNA Insurance and its agent would do such a thing. |
