We hired Michael Fitsimmons of Circa Construction to complete a 2 story renovation/expansion to our residence, 59 Concord Avenue, Oceanside. The project began in September of 2010 and ran pretty smoothly in the beginning. We were well aware of the job that we were taking on and that we would be inconvenienced. Demolition started on the house and our hot water and boiler were disconnected. The first problem came when we were left with no hot water and heat for roughly 6 weeks. Circa Construction was well aware that we would be living in the house and that we had 2 small children. When we questioned when it would be done, he would tell us that he was trying to get a hold of his plumber. His plumber, Belmonte Plumbing of Bethpage, was very unprofessional and did not seem to care that our family was living under these conditions. When he finally did show up, he was complaining that we purchased our new oil burner elsewhere and that Circa Construction owed him money. Neither of these should have effected our project at all and Mike should have taken control of the situation. We were told the project would be complete by Thanksgiving time but it became apparent as time went on that that would not be the case. The week of Thanksgiving, the project really kicked into high gear and we were told that it would be done with the next few weeks. Circa Construction had crew of about 6 men working at this time but that was all about to change. On Thanksgiving Eve, we experienced water damage in our den due to a Circa employee nailing through a heating pipe. The situation probably could have been avoided if Belmonte Heating and Plumbing would have marked where the heating pipes ran under the sub floor. We made several frantic calls to Mike at Circa and none were returned. When he finally called he recommended that we call OSI, our oil burner company. Circa Construction said he would pay our service call to fix the issue. To this day, he owes OSI 530 dollars for service calls and repair work that Belmonte Plumbing did incorrectly. Once December came the 6 man crew turned into a one man crew. Work was slow and being completed at a snails pace. The renovation seemed to be put on hold so Circa Construction could make money snow plowing. We had many days in December and January where no work was completed at all. To make it worse, we were never made aware if anyone was coming to work at our house or not. Our house was left uninsulated and had insufficient coverings during the winter months. We paid about 1500 dollars in one month in oil heating costs due to the fact that we were left uninsulated. We had our back door boarded up with a thin piece of ply wood. We actually had snow in our front vestibule because a front door was not installed. We caught Mike trying to cover up problems that happened on our job site. He drilled through our radiant heat pipe that caused damage to our oak floor. There were damages and scratches to our new tile floor and newly stained wood floors - both of which he did not want to admit to. Circa Construction left debris in our driveway and side of the house daily. We had to pay for a dumpster and I personally removed the debris myself. The last day in March that Mike came to work, he was well aware of all of the outstanding work that needed to be fixed or finished. I called Circa Construction many times and he would always say I will send someone. Someone never came. It's August and someone has yet to come. We have had to pay an outside contractor to finish tile work in the kitchen and bathroom, as well as electrical and plumbing work. He owes us 2 window screens on windows that he installed. He claims we do not need them. We have a valley in our roof line with unfinished siding. It is clear Mike and Circa Construction have abandoned our job. Circa Construction is very unprofessional, dishonest and should be held accountable for his actions. He has threatened my family by putting liens on my house and by holding back our electrical and plumbing permits. He has had verbal fights with my wife and myself. He blames us for losing a future job with a family member and made it very clear how annoyed he is with US for losing the job. I would like it to be on permanent record so that no one has to endure the aggravation and pain my family went through |
