I am an massage therapist at this clinic who was scheduled the same day of the week, every week for six weeks. My last week scheduled, said employer came to me with a wage garnishment for child support, and hour later I was sent home and told I was now "on call" because the business was slow. The following week, Cinnabar said they will still slow and had no massages for me. Since then a few prospective clients I know have a called the clinic to request me personally for a massage. They have all been told that I am not on the schedule and to see another massage therapist. No one at Cinnabar has contacted me regarding these massage requests. It is obvious that I was put "on call" because of the wage garnishment for child support I owe. During my interview I was promised training during "down time". No training as been offered to me as of the date of this report: 8/9/2011 This is discrimination and according to Labor Code Section 2929(b) provides, No employer may discharge any employee by reason of the fact that the garnishment of his wages has been threatened. No employer may discharge any employee by reason of the fact that his wages have been subjected to garnishment for the payment of one judgment. A provision of a contract of employment that provides an employee with less protection than is provided by this subdivision is against public policy and void. Consequently, you may file a retaliation claim with the Labor Commissioners office. Also as an massage therapist I was told to change the blankets over the massage sheets once a week. The sheets were changed with each new client, but the blanket over those same sheets were to be changed weekly. During an occasion that I was in the back room. Lia Andrews the owner of the clinic scooped ants out of a water pitcher and placed the pitcher with the same water back out in the waiting room for clients to drink. There are ant baits throughout the building that these same ants could have crawled through poison and then into that same water left for clients to drink. As a Holistic Health practitioner with over 1000 hours of massage experience, their rate of pay for me was $11.00/hour. |
