We hired this company to help us with a loan modification as we stressed to them that we wanted to keep our home. They then wrote up a fraudulant lawsuite against our lender using CA laws and we live in the state of AZ. When we had several lawyers review this lawsuit and they laughed. And then when they wrote up this lawsuit we were basically on our own and not knowing what to do we had to go to the court house and file ourselves which we should not have had to do especially since Mr. Tuft said he retained a lawyer.
From what we have been told by several legal services when you retain a lawyer they handle all the necessary paper work because that is their job. Also after all of this we have asked Mr. Tuft for all of our paper work and what he has worked on for our case and he tells us he will send but we never get it. After the lawsuit was filed we informed Mr. Tuft that we were going to be pursuing a lawsuit against his company and we just got a letter that Mr. Tuft was filing for Bankruptcy.
The only reason I used this mans business is because he is related to one of my dearest friends and he can talk the talk but when it came down to actually doing the work it was all fraud and lies. My family is devastated and hurt by all of this and now we have had to hire counsel and start all over again. We would like to see a criminal case filed against this man for all of his fraudulant dealing so that he cannot do this to anyone else. His business is taking advantage of people while they are down.

I have never been and never will be a foreclosure consultant. The company I own and operate prepares documents. All of our contracts state very clearly what we do under our scope of duties. We can not save a home owner from foreclosure as that is not a service we provide. This client requested that our company prepare a legal complaint against their lender, which we provided them with. We do not file on behalf of clients nor do we give legal advice to clients as we are not lawyers nor do we have lawyers working within the company. I have responded to months of communication and emails from this client, where the client has stated several times how happy they were with our service. As the client mentions she did come from a referral of a family friend so out of general courtesy at no charge to the client, I personally postponed her trustee sale several times. Again, this is not a service our company was contracted for and this saved the clients thousands of dollars in rent and legal costs for several months. The client also has been emailed her full litigation complaint numerous times and we have documented evidence of the emails containing the work requested and completed. This client makes false and slanderous accusations towards myself and my company in her report and again I remind all clients who have any issues with documents prepared by the company to contact us directly instead of blogging on a message board, so that the items could be handled appropriately. On a separate note, no one can cause you to lose your home but yourself. You have a financial duty and responsibility to always make your payments to your lender in a timely manner and we always remind every client to pay their mortgage or they can risk their home going into foreclosure. Making unnecessary extravagant purchases and taking vacations, all while excessively behind on your mortgage is not a recommended practice when your in foreclosure.
We prepare documents for clients. We do not do foreclosure consulting or deal in that realm of work. For clients to blame a document preparation company of losing their home and try to suggest that we are a foreclosure company is beyond ridiculous and absurd. We have never been hired to do a loan modification and we have no loan modification contract with this client. This is not a national company nor does it make a false claim to be one, but rather a local office that prepares documents for clients needing assistance in various matters. Some of our clients are not home owners nor have they ever owned a home as again we prepare documents for all types of scenarios. One of our most recent clients was a beautician who had a faulty equipment scenario and needed documents drawn up to bring forward to the company who created the equipment. This was not a home owner nor did their case have anything to do with a home. This company remains a perfect example of what a documentation preparation company should be. A company that prepares documents. That is it. We do not partake in any additional activity and can not be held liable for customers outlandish demands that are outside of the work we can conduct. This company has always and always will abide by both state and federal laws that govern it. I do hope this helps to clear up the misunderstandings of the complaints brought on by a client who did not handle their financial obligation to their lender properly.
Again, Home Mortgage & Bankruptcy Services would also like to reiterate that all clients should make sure they investigate any legal organization before you pay them money to save your home. It is illegal for any one to charge up front fees for foreclosure services or to save your home. We also recommend that you visit your local district attorneys website or your attorney generals website to report any sort of illegal business practices by any business who tries to break these laws.
