Chimworks Chimcorp Failure to deliver product. Failed to refund Bedford, Texas

I have been seeking a refund for a product not delivered by Chimworks located in the Dallas/Ft Worth area. Ordered a chimney cap which was to be delivered to me. After almost 1 year, I have yet to have this order fulfilled, nor has the owner followed-through with a refund. I paid the full-price, sent a check to the business address and waited. The product was promised in 2-weeks. After 2 weeks, I called and was reassured that the item would be sent within a week. A week later, I called. Again, the excuse that there was a backlog of orders and my order would be fulfilled within a week. This pattern went on for more than 2 months. My last communication with the owner was that a full refund would be forthcoming, immediately. After a week I called. This time the excuse was the owner's wife had taken ill and he had been consumed with taking care of his wife, but the refund would be sent. It is now 8 months since the initial order. No product and no refund. All phone numbers give a "busy" signal, and no response through e-mails. Reviewing the business history of this company, the BBB of Dallas has revoked membership for complaints similar to mine. Either no services or products were delivered. I live in California, but I have been in contact with the Dallas Police Department to see if there are criminal charges that can be filed against Chimworks. If anyone more local has had similar results with this company, Detective Michael L. McMartin of the Dallas PD should be contacted.
