Cadle Company fraud, default judgement, harrassment newton falls, Ohio |

This company has filed a false judgement against me for a person with the same name and continues to verbally harass me for it. Since the default judgement was served on the real person and they got the judgement against me they continue to harass. The original debt was well over 20 years ago and it isn't mine. |

BEWARE OF THIS COMPANY. I had borrowed 5, 000.00, with interest it was about 7, 000.00 when living in Texas. I paid all but less than 2, 000.00 of the total monies when I had financial problems. I moved back to Ohio, got back on my feet and began paying a collection company for the remainder of the monies. After 15 months of payments I received a note from the collection company that I owed over 6, 000.00. I asked them for the financials, gave them copies of receipts on the monies I had paid in the past, etc. They didn't respond. I continued paying for a few more months giving them ample time to respond. In the last payment I made to the collection company I included a letter that unless they could prove they had authority to collect the monies that I wouldn't pay anymore payments to them and it would be considered paid since the payments should have been close to what was owed, since I had paid most of the loan to the loan company plus payments to them.
Years later I received a notice from the Cadle Company that they had taken over the loan. They now said I owed more than 8, 000.00 . I replied and told them I did not owe these monies, etc. The next thing I know they filed a lawsuit against me in DALLAS TEXAS even though I was living in Ohio. To make a long story short, I had the judge agree that I could attend the hearing via phone. The statue of limitation in Texas had run out, I think it was 7 years at the time. NOW HERE IS THE BEWARE PART. The attorney said something to the judge who said to me that the law in Texas didn't apply to me because I was living in Ohio EVEN THOUGH THE HEARING WAS IN TEXAS COURT. She was a judge in Texas but was applying Ohio law to me. SHE THEN PUT A JUDGEMENT THAT WAS OVER 15, 000.00. YES, FIFTEEN THOUSAND DOLLARS because she not only included the amount being sued but also attorney fees, interest, etc.
The Cadle Company then had the judgement transferred to Ohio and had my wages garnished. Since they were not getting that much money I made a proposal to them that I would set up a bank account, they could deduct payments every two weeks, etc. They accepted that monthly payments would be deducted over a certain period of time for a specific time and the total was less than the judgement amount. Needless to say, at the end of that time period, they came back with a statement showing I owed more than 14, 000.00 still. I told them I was reporting them, etc. They then sent me a letter stating everything had been paid in full. BUT THEY HAVE NEVER FILED WITH THE COURTS THAT IT WAS PAID, STILL SHOW IN THE COURTS IN OHIO THEY HAVE A GARNISHMENT AGAINST ME, ETC. They said they would take care of it but they never did. It's a constant battle with them. I am on vacation for a few weeks and this week everything that has occurred I am including in a letter requesting an investigation by the State Attorney Generals of Ohio and Texas. I am also asking for a review of the case in Texas to see why the judge did not apply Texas law to me.
I suggest you do the same. You also might want to google Cadle Company and the State of Massachusetts. Very interesting what they have done to others. |
