On 9/14/11, I purchased Business-In-a-Box from Biztree, Inc. I initially tried the Demo (which did not show you a lot of options, at least that I could find), and purchased the product since it offered a "30 day Money back Guaranty ( this link ... https://www.biztree.com/checkout/orderForm). I downloaded and tried the product, and many off the purported forms were amatuer-ish at best and were useless to me. I emailed Biztree for my refund. Today, I received the following email from Martha MacGuire, Customer Service Manager: "We received your email regarding a refund request. It is clearly indicated in several key locations of our website to Download our Free Demo. The free demo allows you to preview and modify every single document of our 1,500+ business and legal template collection. The difference with our free version and our PRO version is that the PROversion allows one to use cut, copy and paste functions, export content into other applications and save documents in the following formats: Microsoft Word (.doc) and Rich Text Format (.rtf). We provide the free demo to ensure one can see how our software works and view all the content of the templates. As stipulated in our 30-Day Money Back Guarantee which can be found on our website: "Due to the digital nature of our products, only valid claims for refunds shall be considered. This policy is not intended to provide users with a free trial. As with all in-store purchases, it is the customers' responsibility to determine whether the product is appropriate for them before purchasing the product." "If any documents or materials have been used in the course of actual business, we will NOT issue refunds. We reserve the right to refuse any refund request, at our own discretion, should we determine that a customer is not providing valid grounds for a refund or is abusing our money back guarantee policy." We see you activated our software on September 14th from IP address xx.xxx.xx.xx. Considering that you had access to a demo but still activated our product, we believe you did in fact "consume" the product. As for software purchased in stores, if it is activated it can't be returned. Also, please understand that there are costs associated to your order (credit card fees, customer service, ebooks, etc), which we cannot reimburse. As indicated in our policy, should a product be activated it is considered consumed. It’s like buying a DVD from a store. If the store has a 30 day money back guarantee, they will take back the DVD, but if it has been opened, they will not. Our product being activated = being used. In summary, seeing that a free demo was provided and you chose to purchase the product and activate it, we will not be able to refund your order. So basically BizTree baits you with the money back guaranty and accuses you of "abusing their money back guarantee policy" if you do not like their product. I am filing complaints with the FBI and the US Postmaster General, as I feel I was totally ripped off here. |
