This company somehow obtained my in case of emergency contact information from Overlake Hospital (who they are collecting on behalf of) and called my boyfriend to ask for me. The number that called him was the same number that had called me earlier that day, they identified their company as ACS to him, they contacted him a few hours AFTER I had agreed to pay them. That day I agreed to pay off my balance of $53.16 to them my next paycheck 9/15/10 (a few days from then), the guy on the phone said he would call me back on th 15th. I dont know if they ever called back on the 15th. I didnt end up paying the balance. A woman from ACS "legal dept" called me on 10/4/10 saying that I needed to pay before they take "further action". I told her I would pay my next pay check 10/15/10. She said, "what happened to the 15th of last month?" I told her nobody called me on 9/15/10, she said they did. She listed off numerous days they had called me (3 or 4 times before the end of the month, I cant remember what days) then she said, "we called your cell, home and work number, all no answer". Then I said "yes, and you also called my in case of emergency contact and I'm not sure how you got that information." She then proceeding to laugh in a very condescending way, and then said "(my name), we have a contract with Overlake and we are allowed to call you." Then I said, "that must breech some sort of confidentiality". She laughed again, it seemed I made her angry, she then said "okay, (my name), it looks like you have been running us around for the past few months, so I'm going to go ahead and approve this for legal action and we are going to sue you, I'll see you in court." Then she hung up the phone. They say they are going to SUE me, which costs $50 in filing fees, for a $53.16 past due balance. The woman laughed at me multiple times, when I was trying to arrange to make a payment. This has been going on for two months, I could understand that they would harass me if the amount was larger or if this was going on for a long time, but the second time I spoke with someone from their company, they were threatening to sue me. I filed a BBB complaint and have yet to hear back, I am also going to look into my HIPAA rights and any apparent violations that this company or Overlake Hospital may have violated by giving out the number of my "Emergency Contact". |
