| Jason Lee Nester is an artist,and creates art for indie game developers,i started making games about a year ago,using game salad and jason was a respected artist on the forums.so i thought it would be ok to use jason for work,we agreed on the style of the art and a price,as neither of us had'nt known each other we also agreed that i would pay half. On the 16th Aug 2011 at 19:32 i payed Jason Lee Nester $150 to produce artwork for a game idea i had in mind. now three or four weeks had past,and i got in contact with jason to say i no longer needed the graphics and would like my money back as non of the graphics had even been made yet,jason agreed to pay me back my money for the services i'd hired him for ,but low and behold that was the last time i've spoken to jason,i've sent in access of twenty to thirty emails asking for my money back,with no reply. I thought well maybe he's in a financial crisis,and cant pay me back.So i explained in an email that if that was the case no problem im human,just let me know when you can pay me back. still no email,i used paypal but unfortunately if you dont make a claim within 45 days they wont do anything. so the only other alternative i have is to let people know that his organisation is a ripp off,and hopefully business will stop and he'll lose money. For someone to work in this manner,is completely unprofessional. and i wont stop until i get my money back.this is the first step to many,believe me jason,i will not stop i promise. Stay away from True Media and stay away from Jason Lee Nester. |

My name is Jason Nester and I am a full time designer as well as a part time indy game designer.
Paul contacted me the week my son had been born asking me to work on a project for him.
I agreed and also agreed to a lower cost on the entire project as I was feeling good and wanted to do something nice. My one condition was that I be paid an upfront cost of $150 to ensure I wasn't going to be ripped off etc.
I spent the next few days working on his project creating backgrounds and vehicles as well as the actual logo/branding for his game.

I also put together an actual game project with an animated intro etc.
I brainstormed with him came up with a name for the game with him and that was that. I continued working on some different designs for the game. All the while he was sending me 3d rendered versions of the ships and talking about using another game engine I was not skilled in. I asked him "why he even needed me" and he assured that he did.
A wee or so went by and I heard nothing from Paul until I received an email claiming that he was going to use a different game engine and no longer needed my services. And asked if I would kindly refund the initial payment in full.
Keep in mind I had already put in at least 6-10 hours into the project. My usual hourly rate is $35 dollars, and even at a discounted rate of $20 dollars an hour it would still bump the total hourly rate to well over 200. I have worked in corporate america for a while now, and know that just because you change your mind and decide that you dont want something middway through you still need to pay your dues.
I even out of the kindness of my heart an to avoid conflict decided halfway through that I would send him $100. And after a week of saying he hadn't received the payment I canceled the transaction. HE then told me to use a different email address but at that point I didn't have the cash at hand. So I in no way could pay him even as a peace offering. Even though I was within my rights to not do so.
Over the last 2 months I have been dealing with alot of personal issues that kept me away from design work and the gaming industry as well as my email. I only had bits of time in the wee hours of night to even attempt to work on anything. So I focused on my family and my full time job. All the while because I receive so many requests my inbox had become quite a cluttered mess. When things started to taper down within the last week or so I decided to try and get organized and I see 20-40 harassing emails a day, as well as threats from this guy.
He is currently trying to send me personal tidbits of information about myself through my email as well as trying to find out where I live.
I had planned on paying him yesterday or today when my itunes money came through and it has but with his behavior and the way he has handled this situation the odds of him getting any sort of refund have went from slim to none. I refuse to do business with a person who reacts like a toddler instead of the adult that I assume that he is.
Which brings me to my next point: There was never a contract of any kind. This wall all done in a very under the table sort of fashion.
And the bottom line is this: I am within my rights to not pay him back money that went in to the initial development of his game. I put the time in regardless of whether or not he changed his plans. I understand that he is frustrated but that is reality.
I would have and fully intended on working something out with him to ease his frustration but he has slandered my name all over the internet and threatened me. In no way is he going to get paid.
gamedivisionuk is his alias and from what i have seen of him within my game platform community he is a troublemaker. I have plenty of happy clients from over the years and even offer my services for free from time to time to younger and under-experienced developers. I have had very few complaints actually just one, and it is this guy.
